Taranto, 26 maggio 2020 – Un emozionato Emidio Deandri, presidente dell’ANMIL di Taranto, commenta la notizia di un’importante sentenza del 23 maggio relativa a un giudizio promosso, dinanzi al Tribunale del Lavoro di Taranto, dagli Avvocati Maria Luigia Tritto e Cataldo Tarricone, Consulenti Legali ANMIL, avverso l’Amministrazione statale. “Dopo anni di udienze questa esemplare sentenza – ha detto Deandri – rende finalmente giustizia a un lavoratore che ha contratto sul posto di lavoro una terribile patologia, il mesotelioma polmonare. Peccato che lui, ucciso dalla malattia in meno di un anno, oggi non sia qui tra noi per gioirne insieme alla moglie e alle due figlie”.
“Rattrista constatare che in questo strano Paese – ha poi commentato con amarezza il Presidente – più riesci a sopravvivere a una malattia contratta sul posto di lavoro, più alto sarà l’indennizzo di cui godrà chi ti è stato vicino durante la malattia. Ringrazio gli Avvocati Maria Luigia Tritto e Cataldo Tarricone, nostri consulenti legali che, con straordinaria competenza professionale, da anni sostengono la battaglia dell’ANMIL di Taranto per la tutela dei diritti di tutti gli invalidi e infortunati sul posto di lavoro, nonché dei lavoratori affetti da malattie professionali”.
A.C.C. era deceduto esattamente nove anni fa, nel maggio del 2011, a causa di un mesotelioma polmonare. Quando la patologia si era manifestata, circa un anno prima, era dipendente civile del Ministero della Difesa, in Marina Militare, in servizio presso l’Arsenale Militare Marittimo di Taranto, con mansioni di ausiliario presso l’officina del porto base navale e marinaio di coperta.
Poco prima di morire A.C.C. aveva denunciato la malattia professionale, ma le relative provvidenze venivano riconosciute solo dopo la sua morte a seguito di un primo giudizio promosso, dinanzi al Tribunale di Taranto, dagli Avvocati Tritto e Tarricone. Tre anni addietro la vedova e le due figlie promuovevano un nuovo giudizio avverso il Ministero della Difesa per ottenere il risarcimento, in qualità di eredi, del danno biologico differenziale e morale occorso al loro congiunto. La sentenza è stata emessa venerdì scorso, 22 maggio, dal Giudice del Tribunale di Taranto Giovanni De Palma. In una articolata motivazione il Giudice ha evidenziato come, a fronte della provata nocività dell’ambiente di lavoro, con particolare riferimento alla presenza ed all’utilizzo di amianto, nessuna valida indicazione in ordine all’adozione delle cautele necessarie per impedire il verificarsi del danno è stata promanata durante il processo dal convenuto Ministero della Difesa, comunque gravato dal relativo onere di allegazione e prova. È infatti risultato che, all’interno dei pontoni in cui operava come marinaio di coperta il dipendente A.C.C., vi fossero locali per lo stazionamento nei momenti di pausa in cui c’erano caldaie, condutture e tubi, coibentati in amianto, i cui rivestimenti “si usuravano nel tempo” ed erano “riparati alla meglio”. Ora il Ministero della Difesa dovrà risarcire alle eredi la somma di euro 70.943,26 oltre accessori di legge. Tale importo è stato calcolato applicando le note tabelle del Tribunale di Milano in base al periodo, purtroppo poco meno di un anno, di sopravvivenza del lavoratore A.C.C. dalla data in cui la patologia si è manifestata, sino al suo decesso.
