Roma, 30 marzo 2022 – I rider sono diventati sconosciuti all’INPS. La denuncia arriva direttamente dal Presidente dell’Istituto, Pasquale Tridico, il quale ha rivelato come, esauriti gli effetti delle maxi sanzioni ricevute nel 2021 dalle principali multinazionali del food delivery, i rider sono completamente spariti dagli archivi INPS. Nel 2021, a seguito di un’inchiesta della Magistratura di Milano, le piattaforme di consegna di cibo a domicilio erano state multate per 155 milioni di euro, tra sanzioni e contributi evasi, e l’operazione aveva portato alla luce circa 30.000 lavoratori coinvolti. Oggi però, spiega Tridico in audizione al Senato sulla proposta di direttiva UE sull’inquadramento dei lavoratori delle piattaforme digitali, “non risultano più lavoratori dichiarati nei nostri archivi, né come subordinati, né come collaboratori, né come etero organizzati: le aziende infatti li dichiarano come prestazioni occasionali, fino a 4.999 euro, salvo poi interrompere il rapporto di lavoro per non sfondare il tetto del 5mila euro previsto dalla legge”. Questo nonostante “ci siano stati annunci da parte di alcune importanti società del food delivery che avevano garantito una riclassificazione dei lavoratori” aggiunge Tridico. Secondo il Presidente dell’INPS l’universo dei rider è invece in continua crescita, spinto anche dalla pandemia: dai 10mila censiti nel 2018 si è passati ai circa 30mila di oggi, emersi nel corso delle recenti indagini e dagli accertamenti ancora in corso. Per superare le ambiguità normative relative all’inquadramento dei rider, per Tridico “occorre un’indicazione legislativa chiara: quella giurisprudenziale e della magistratura suggeriscono la via della subordinazione del lavoratore”, orientamento anche della proposta di direttiva UE che deve essere approvata dall’Europarlamento e che dovrà essere poi tradotta nei diversi contesti legislativi nazionali. L’INPS intanto, per cercare di monitorare al meglio questo segmento, ha messo a punto un prototipo di piattaforma digitale da gestire in collaborazione con l’INAIL “per garantire una tracciabilità continua, anche se intermittente, considerate le specificità del lavoro dei rider, per fini protettivi, sociali, assicurativi e previdenziali” spiega Tridico, sottolineando anche che il meccanismo garantirebbe una forma di controllo su assunzioni e licenziamenti.
