Roma, 30 marzo 2020 – In considerazione della registrazione da parte dell’Istat di una variazione percentuale dell’indice dei prezzi al consumo delle famiglie di operai e impiegati pari all’1,10%, l’INAIL ha provveduto a comunicare con circolare n. 9 del 26 marzo 2020, con decreto del Ministro del lavoro e delle politiche sociali n. 147 del 17 ottobre 2019, che è stata disposta la rivalutazione annuale degli importi degli indennizzi del danno biologico con decorrenza 1° luglio 2019.
Tale rivalutazione si aggiunge all’incremento riconosciuto per effetto della rivalutazione riferita all’anno 2018 e si applica agli importi degli indennizzi del danno biologico in capitale riferiti alla tabella vigente in relazione alla data dell’evento lesivo e agli importi degli indennizzi in rendita per gli eventi a decorrere dal 25 luglio 2000, esclusivamente sulla quota parte dei ratei relativa all’indennizzo del danno biologico (come da tabella approvata con decreto ministeriale 12 luglio 2000).
La rivalutazione degli importi degli indennizzi del danno biologico, come sopra delineato, riguarda i ratei di rendita maturati e gli indennizzi in capitale liquidati dal 1° luglio 2019.
Gli importi relativi alla rivalutazione (dovuta ai sensi del citato decreto ministeriale 17 ottobre 2019, n. 147) saranno liquidati d’ufficio, con le consuete modalità di pagamento delle prestazioni economiche e con l’invio agli interessati di apposito provvedimento di liquidazione della Sede di competenza elaborato a livello centrale. In merito a quanto descritto, la circolare INAIL fornisce indicazioni su alcune casistiche specifiche:
Per i ratei di rendita maturati a decorrere dal 1°luglio 2019, l’incremento si applica agli importi relativi alla quota che ristora il danno biologico in aggiunta all’incremento relativo alla precedente rivalutazione anno 2018. I predetti importi sono stati corrisposti con il rateo di rendita del mese di marzo 2020.
Per gli indennizzi in capitale, l’incremento dovuto a titolo di rivalutazione, si applica agli importi erogati a seguito di provvedimenti emanati a decorrere dal 1° luglio 2019. Nello specifico:
– Per quanto riguarda gli indennizzi in capitale liquidati dal 1° luglio 2019, relativi a eventi lesivi antecedenti al 1° gennaio 2019 (non rientranti nelle disposizioni di legge afferenti alla vigente tabella) l’incremento si applica sull’importo complessivo in base alla precedente tabella di indennizzo del danno biologico (decreto ministeriale 12 luglio 2000), maggiorato della percentuale del 16,25% relativa ai precedenti aumenti straordinari nonché all’incremento relativo alla precedente rivalutazione anno 2018.
– Per quanto riguarda gli indennizzi in capitale liquidati dal 1° luglio 2019 relativi a eventi lesivi dal 1° gennaio2019 (per i quali trova applicazione la vigente tabella del danno biologico in capitale, ai sensi della citata legge 30 dicembre 2018, n. 145)l’incremento si applica sull’importo del valore capitale corrispondente al grado di menomazione dell’integrità psicofisica e all’età dell’infortunato/tecnopatico, comprensivo di aumenti straordinari, nonché all’incremento relativo alla precedente rivalutazione anno 2018.
– Per gli accertamenti provvisori dei postumi effettuati a decorrere dal 1° luglio 2019, in caso di assenza della definitiva valutazione del grado di menomazione la rivalutazione sarà corrisposta a seguito di accertamento definitivo dei postumi.
– Per gli accertamenti provvisori dei postumi con erogazione del relativo acconto in data antecedente al 1° luglio 2019, e accertamento definitivo successivo a tale data, la rivalutazione si applica all’importo eventualmente dovuto a seguito della valutazione definitiva dei postumi.
– Per i casi di revisione e di aggravamento la rivalutazione si applica solo ai maggiori importi eventualmente liquidati a far data dal 1° luglio 2019.
