Roma, 25 febbraio 2021 – “In piena pandemia obbligano i riders a consegnare ai piani, pena abbassamento del punteggio”. E’ il commento di un rider postato su un gruppo Facebook che raccoglie gli sfoghi e i commenti dei “ciclofattorini” di tutta Italia. Il messaggio è riportato assieme a molti altri in una relazione dei Carabinieri del Nucleo Tutela Lavoro, agli atti dell’indagine della Procura di Milano con al centro le filiali italiane delle principali società di delivery e nella quale ci sono 6 indagati. A un ragazzo, invece, che chiedeva ai colleghi istruzioni per ottenere il rimborso per l’acquisto di gel, disinfettanti e mascherine, è stato spiegato, si legge nella chat, che la rifusione delle spese avveniva a “inizio pandemia, più o meno quando non riuscivano a mandare i kit” e che ora “non credo esista più”. La relazione, inoltre, sottolinea come in seguito all’emergenza epidemiologica “il settore del delivery food ha avuto un incremento esponenziale che ha portato (…) migliaia di nuove richieste di accreditamento come rider sui siti delle piattaforme” di Foodinho-Glovo, Uber Eats Italy, Just Eat Italy e Deliveroo Italy, e fornisce un quadro della loro policy aziendale relativa ai dispositivi di protezione. Se Uber, come ha comunicato la stessa società, ha rimborsato Dpi ai fattorini per 2700 euro dopo quasi 7 mesi di pandemia e Deliveroo ha distribuito “oltre 1200 mascherine per la Regione Lombardia” attraverso i “ristoranti clienti”, per tutte sono “lavoratori autonomi, e quindi sono “tenuti a garantire di disporre delle attrezzature di sicurezza necessarie per svolgere il proprio lavoro in perfetta autonomia”.
Intanto, proprio a seguito dell’inchiesta, potrebbero aprirsi una lunga serie di cause civili davanti al Tribunale del Lavoro. Gli ispettori del lavoro, a seguito anche degli accertamenti di investigatori e inquirenti, hanno notificato a quattro colossi del settore, Glovo-Foodinho, Just Eat, Uber e Deliveroo, verbali amministrativi nei quali si indica che le posizioni di oltre 60mila ciclofattorini vanno regolarizzate, da lavoratori autonomi a coordinati continuativi, con tutte le garanzie dei subordinati. In realtà, a quanto riferito, questi verbali (diversi da quelli penali sulle violazioni di profili di salute e sicurezza che hanno portato ad ammende per oltre 733 milioni) sono procedimenti amministrativi.
L’ispettorato del lavoro indica alle aziende di sanare le posizioni, sul fronte soprattutto dei contributi, di rider che, come emerge dalle indagini, hanno lavorato dal 2017 e fino all’autunno scorso. Ogni lavoratore, poi, dovrà, se vorrà, fare una causa di lavoro alla società.
Nel caso delle contestazioni che riguardano i reati contravvenzionali per le violazioni sul fronte della sicurezza e della salute dei rider, entro 90 giorni le società dovranno adempiere alle prescrizioni indicate nei verbali e pagare un quarto della cifra massima delle ammende e, quindi, versare, come è stato calcolato, oltre 733milioni (la cifra è già un quarto delle multe totali). Così si estinguerà il procedimento penale, che in caso contrario andrà avanti. Nel frattempo, Assodelivery ha fatto sapere di aver aperto un percorso di approfondimenti dei documenti: “Valuteremo ogni azione conseguente”, fanno sapere.
