Roma, 23 luglio 2021 – Il Direttore Capo dell’Ispettorato Nazionale del Lavoro, Dott. Bruno Giordano, è stato ascoltato in audizione dalla Commissione di Inchiesta sulle condizioni di lavoro in Italia. Sfruttamento, sicurezza sul lavoro e attività ispettiva sono stati al centro dell’intervento dell’ex magistrato, da pochi giorni alla guida dell’Ispettorato, che ha esposto alla Commissione i principali dati emersi dall’attività giudiziaria portata avanti negli ultimi cinque anni, a seguito della riforma del reato di sfruttamento lavorativo.
“Lo sfruttamento ha risvolti negativi sia sul piano micro che macroeconomico” ha rilevato Giordano “in quanto costituisce concorrenza sleale nei confronti delle imprese sane che rispettano le regole e un danno più esteso per l’economia, con un aggiramento totale dello stato sociale, evasione fiscale, assicurativa e previdenziale”.
“Negli ultimi anni è stato possibile rilevare delle caratteristiche precise dello sfruttamento lavorativo” ha osservato “la prima è la sua diffusività sia sul piano territoriale che sociale: non è più un fenomeno che interessa solo i campi e le regioni meridionali, ma esiste da nord a sud e coinvolge diversi settori della vita sociale, dell’agricoltura alla cantieristica navale”. “La seconda costante è la motivazione economica: si sfrutta il lavoro per risparmiare, ma è un luogo comune che ciò avvenga in un’economia povera. Lo sfruttamento del lavoro è invece tipico di un’economica forte che incentra l’attività di impresa attorno al profitto oltre le regole e a costo della dignità umana. Lo sfruttamento aumenta dove è alta la domanda di lavoro”. C’è poi il controllo del territorio, la conoscenza delle imprese disposte ad accettare manodopera irregolare, l’utilizzo improprio di forme contrattuali che dissimulano lavoro irregolare e, nella totalità dei casi “violazione delle norme in materia di salute e sicurezza sul lavoro”.
Le frontiere dello sfruttamento oggi sono nuove e sconosciute fino a qualche anno fa: le piattaforme on line, la logistica, l’assistenza. “Basti pensare – sottolinea Giordano – che il più grande processo per sfruttamento lavorativo in Italia al momento non riguarda né agricoltura, né il sud né i caporali: riguarda multinazionali e riders nella ricca Milano. Per questo dobbiamo abituarci a ragionare in termini nuovi”.
Numerosi gli elementi che rendono l’attività ispettiva e giudiziaria in questo ambito molto complessa: “C’è bisogno – osserva Giordano – non solo di incrementare il numero di ispettori, ma anche di creare un’intelligence che sappia muoversi su più fronti, con alte competenze tecniche e specialistiche”. “In Italia ci sono oltre dieci organi di vigilanza diversi in materia di lavoro e ciò fa mancare una politica nazionale forte su questi temi. Non basta un coordinamento – precisa il capo dell’Ispettorato – ma serve unificare il più possibile questi enti e porre sullo sfondo una Procura Nazionale del lavoro che sappia dare una direzione univoca, attraverso la specializzazione, sia alle attività investigative che a quelle processuali”.
