Roma, 2 settembre 2021 – Il Tar Lazio respinge le istanze di sospensione di tutti i provvedimenti adottati dal ministero dell’Istruzione con cui è stata stabilita la disciplina in materia di possesso di certificazione anti-covid del personale scolastico.
Con i decreti monocratici nn.4531/2021 e 4532/2021 depositati oggi il Tar, in ordine “al diritto del personale scolastico a non vaccinarsi, il diritto alla salute non ha valenza assoluta né può essere inteso come intangibile”. Per il personale scolastico non in possesso del Green pass “l’automatica sospensione dal lavoro e dalla retribuzione e la mancata adibizione ad altre e diverse mansioni è correttamente e razionalmente giustificabile alla luce della tipicità delle mansioni, specie di quello docente”.
“Si tratta di una decisione esemplare in quanto riafferma alcuni basilari principi della convivenza democratica”, commenta il presidente dell’Anp, Antonello Giannelli. “Ritengo particolarmente condivisibili le parole dei giudici amministrativi – prosegue – secondo cui l’automatica sospensione dal lavoro e dalla retribuzione e la mancata adibizione del personale scolastico ad altre e diverse mansioni è correttamente e razionalmente giustificabile alla luce della tipicità delle mansioni del personale scolastico, specie di quello docente. Spero che questo contribuisca a superare definitivamente le pretestuose polemiche sollevate strumentalmente da alcuni e renda più agevole il lavoro dei colleghi impegnati a garantire il diritto allo studio”.
