Roma, 15 aprile – “I parametri usati per gli anticipi dei pagamenti delle pratiche effettuate dai patronati sono fermi al 2015”. Lo dice, in un’intervista all’Adnkronos/Labitalia, Giuseppe Santoianni, presidente dell’Associazione italiana coltivatori che, oltre ad offrire la rappresentanza agli operatori del mondo agricolo, fornisce assistenza e garantisce servizi fiscali, sindacali e di consulenza sia attraverso i propri e quelli degli enti promossi dall’organizzazione stessa, in particolare il patronato Inpal, l’Aic-pensioni; l’Aic-disoccupazioni; la Fnp (Federazione nazionale pensionati); l’Untia (Unione nazionale tutele in agricoltura); il Caf-Aic (Centro di assistenza fiscale); il Caa-Aic srl (Centro di assistenza agricola); l’Enpaica (Ente nazionale addestramento professionale per l’agricoltura-l’industria-il commercio e l’artigianato); la Fenaidd (Federazione nazionale imprenditori e datori domestici).
“Tutti i patronati – spiega – fanno le pratiche nelle loro strutture attraverso l’operato dei dipendenti. Si tratta di attività che vengono fatte per l’Inps, l’Inail e anche ministero dell’Interno per quanto riguarda il reddito di cittadinanza. Il problema principale è il pagamento di queste pratiche che vengono effettuate; i patronati non ricevono i fondi sulla base dell’attività che svolgono nell’anno, ma ricevono i fondi rispetto a un parametro determinato in un’annualità prevista dalla direzione generale per le Politiche previdenziali e assicurative. Un’annualità – sottolinea – che viene dagli ispettori del lavoro che devono andare a controllare sede per sede, pratica per pratica tutte le attività di ogni patronato. Ad oggi il ministero del Lavoro dà degli anticipi rispetto alle attività che vengono fatte nell’anno precedente. Ad esempio, in questi giorni dovrebbe uscire il decreto di ripartizione per l’attività del 2020, il problema è che non viene fatto sull’attività veramente del 2020, ma su un parametro che è del 2015, peraltro non completato al 100%. Così dal 2015 al 2020 molti patronati hanno aumentato la loro attività magari raddoppiandola, eppure si vedono gli anticipi rispetto al 2015. Quindi quei patronati che sono cresciuti e che hanno aumentato il personale e le sedi, pagando più affitti, devono anticipare le spese con proprie risorse”. “I patronati – osserva Giuseppe Santoianni – che sono cresciuti negli ultimi anni chiedono un cambiamento di approccio nei confronti di questa problematica: perché dobbiamo aspettare gli ispettori che devono andare a vedere pratica per pratica, quando in realtà tutti i patronati sono obbligati a dare ogni anno il dato dell’autodichiarazione, dove si dichiara di aver fatto ‘tot’ pratiche che vengono inserite sui sistemi di Inps, Inail e ministero dell’Interno?”. “Il dato dichiarato dai patronati – insiste – non viene preso in considerazione anno per anno, al contrario viene considerato quello del 2015. Il ministero del Lavoro ha i dati dell’Inps, dell’Inail, del ministero dell’Interno e l’autodichiarato, eppure il ministero si basa sui dati 2015 dell’Ispettorato”. “Inoltre – avverte – mancano tutti i conguagli dal 2013. Con questo sistema alcuni patronati avranno di meno rispetto all’attività svolta, altri di più perché in sei anni le cose sono cambiate”.
Ma non basta. Santoianni mette in evidenza anche altre cose che non vanno per quanto riguarda la struttura tecnologica. Gli ispettori, per esempio, controllano l’operato dei patronati con verbali scritti a penna, e per il futuro proponiamo – aggiunge Santoianni – che facciano fede le banche dati dell’Inps, dell’Inail e del ministero dell’Interno, visto che le istituzioni hanno le loro banche dati al passo con la tecnologia”. “Ad esempio – spiega – l’Inps ha il codice della pratica, del patronato e della sede, tutti dati che può trasferire al ministero del Lavoro. Così, sulla base delle pratiche fatte da ogni patronato, dà il punteggio e, quindi, i fondi necessari senza incorrere in ritardi ed errori come accade ora”. “Il controllo – propone Santoianni – si può fare in due situazioni con un back office che verifichi eventuali anomalie e con studi e ricerche dai quali si potranno ricavare controlli ex post”.
“Il decreto di ripartizione dei fondi a favore dei patronati Inpal ed Encal è sbagliato a causa di un file excel errato compilato dagli ispettori territoriali e, nonostante una sentenza del Tar, il file è ancora vigente, con una perdita pari a circa 4 milioni di euro”. “Tutto nasce – racconta – quando nel 2015 l’Inpal fa una fusione con l’Encal diventando un unico patronato, unione però a cui nel 2019 ha fatto seguito una scissione. Nel 2019 è stato richiesto e fatto un atto notarile dove figurava il decreto di ripartizione firmato dai due patronati che si dividevano; però nel 2015 invece di verificare i verbali, sono stati distribuiti i fondi per il 2015 non in base al piano di riparto approvato con l’atto notarile, ma sulla base di una compilazione di un file excel, fatto dagli ispettori territoriali”.
