Roma, 3 maggio 2022 – È stato pubblicato in Gazzetta Ufficiale il Decreto Legge 30 aprile 2022, n. 36 recante “Ulteriori misure urgenti per l’attuazione del Piano nazionale di ripresa e resilienza (PNRR)”.
Tra le molteplici misure, il provvedimento introduce:
• il Portale nazionale del sommerso (PNS) (art. 19)
In particolare, modificando l’art. 10 del D.Lgs. 23 aprile 2004, n. 124 e al fine di una programmazione efficace dell’attività ispettiva, nonché del monitoraggio del fenomeno del lavoro sommerso su tutto il territorio nazionale, i risultati dell’attività di vigilanza svolta dall’Ispettorato nazionale del lavoro (INL), dal personale ispettivo dell’INPS, dell’INAIL, dell’Arma dei Carabinieri e della Guardia di Finanza avverso violazioni in materia di lavoro sommerso e in materia di lavoro e legislazione sociale, dovranno confluire nel Portale unico nazionale gestito dall’Ispettorato Nazionale del Lavoro. Il Portale nazionale sostituisce e integra le banche dati esistenti attraverso le quali l’Ispettorato Nazionale del Lavoro, l’INPS e l’INAIL condividono attualmente gli esiti degli accertamenti ispettivi. Inoltre, si prevede che nel Portale confluiscano i verbali ispettivi, ogni altro provvedimento consequenziale all’attività di vigilanza, compresi tutti gli atti relativi ad eventuali contenziosi conseguenti al verbale stesso;
• misure per il contrasto del fenomeno infortunistico nell’attuazione del PNRR e per il miglioramento degli standard di salute e sicurezza sui luoghi di lavoro (art. 20).
Per assicurare un’efficace azione di contrasto al fenomeno infortunistico e di tutela della salute e della sicurezza nei luoghi di lavoro, il Decreto Legge prevede che l’INAIL promuova appositi protocolli di intesa con aziende e grandi gruppi industriali impegnati nell’esecuzione dei singoli interventi previsti dal PNRR. In particolare, la norma dispone che, tra gli altri, vengano realizzati: programmi straordinari di formazione in materia di salute e sicurezza che, fermi restando gli obblighi formativi spettanti al datore di lavoro, mirano a qualificare ulteriormente le competenze dei lavoratori nei settori caratterizzati da maggiore crescita occupazionale in ragione degli investimenti programmati; progetti di ricerca e sperimentazione di soluzioni tecnologiche in materia, tra l’altro, di robotica, esoscheletri, sensoristica per il monitoraggio degli ambienti di lavoro, materiali innovativi per l’abbigliamento lavorativo, dispositivi di visione immersiva e realtà aumentata; sviluppo di strumenti e modelli organizzativi avanzati di analisi e gestione dei rischi negli ambienti di lavoro, inclusi quelli da interferenze generate dalla compresenza di lavorazioni multiple; iniziative congiunte di comunicazione e promozione della cultura della salute e sicurezza sui luoghi di lavoro.
Inoltre, il provvedimento introduce disposizioni in materia di riforma del reclutamento del personale della Pubblica Amministrazione, anche a favore dell’equilibrio di genere (articoli 1-17), nonché di rafforzamento del sistema di certificazione della parità di genere nell’ambito del Codice dei contratti pubblici (art. 34).
