Roma, 8 ottobre 2021 – Il giudice monocratico Miriam D’Amore del Tribunale di Gela ha condannato due funzionari della RFI – Rete Ferroviaria Italiana e ne ha assolti altri sette per la morte di tre operai, travolti il 17 luglio del 2014 da un treno regionale mentre lavoravano ai binari della tratta ferroviaria Gela-Licata.
Nell’incidente persero la vita Antonio La Porta di Porto Empedocle, Vincenzo Riccobono di Agrigento e Luigi Gaziano di Aragona. Il pubblico ministero aveva chiesto pene comprese fra 6 e 8 anni di reclusione. Sono stati condannati a due anni ciascuno (pena sospesa e non menzione) per omicidio colposo plurimo il dirigente centrale operativo della sala di coordinamento centro controllo della circolazione di Palermo, Pietro Muscolino, e il responsabile della linea operativa della tratta Canicattì-Gela, Rosario Cilluffo. I due imputati avrebbero dovuto valutare il rischio che correvano gli operai e interrompere la circolazione ferroviaria. Sono stati assolti l’ex amministratore delegato di Rfi, Michele Mario Elia; il responsabile della direzione territoriale di Palermo, Andrea Cucinotta; il dirigente dell’unità territoriale di Caltanissetta, Concettina Vitellaro; il capo impianto del reparto lavori, Pietro Messina; il capo reparto pianificazione unità territoriale di Palermo, Carmelo Lapaglia; Giovanni Costa, responsabile della direzione tecnica. Non hanno commesso il fatto gli imputati difesi dagli avvocati Francesco Bertorotta, Fabrizio Biondo, Vincenzo Lo Re, Francesco Crescimanno, Salvatore Buggea, Assolta anche Rfi (avvocato Giovanni Grasso) che rispondeva di un illecito amministrativo.
La procura di Lodi ha chiuso le indagini, in vista della richiesta di rinvio a giudizio, per 15 persone, tra cui Maurizio Gentile, ex amministratore delegato di Rete Ferroviaria Italiana, e Michele Viale, presidente e ad di Alstom Ferroviaria, e per le due società, per l’incidente ferroviario del Frecciarossa 1000 che il 6 febbraio 2020 è deragliato a Ospedaletto Lodigiano (Lodi) causando la morte di due macchinisti e il ferimento di 10 passeggeri.
I reati contestati dal Procuratore della Repubblica Domenico Chiaro e dal pm Giulia Aragno sono disastro colposo e omicidio colposo plurimo. Stralciata la posizione di sei persone in vista dell’istanza di archiviazione, tra cui quella di Marco Donzelli, responsabile dell’unità territoriale di Bologna per Rfi.
