23 febbraio 2021 – Vaccinarsi contro il COVID 19 è una scelta legittima e personale, ma cosa succede se poi si contrae il virus? Il lavoratore può far riconoscere la positività come infortunio sul lavoro? Ē atteso il parere dell’INAIL sul caso dei 15 infermieri dell’Ospedale San Martino di Genova che sono risultati positivi al COVID dopo essersi rifiutati di farsi vaccinare, ma l’ago della bilancia sembra già propendere verso il “no”.
Fino a fine gennaio i casi di COVID denunciati all’Inail sono stati 147mila, circa il 5% del totale, mentre le morti denunciate per contagio sul posto di lavoro sono state 461. L’ex ministro del Lavoro Cesare Damiano, attualmente componente del Consiglio d’Amministrazione dell’INAIL, non ha dubbi:” La soluzione migliore – spiega – sarebbe una legge sull’obbligo di vaccinazione almeno per alcune categorie. A mio giudizio è logico che chi decide di non vaccinarsi e svolge una mansione a rischio poi non possa chiedere il riconoscimento dell’infortunio sul lavoro. Anzi, dovrebbe essere messo nelle condizioni di non essere un pericolo per sé e per gli altri, evitando il licenziamento, ma svolgendo mansioni che non hanno contatto con il pubblico”.
