Roma, 1 febbraio 2021 – Il giudice del Lavoro del Tribunale di Taranto Giovanni De Palma, accogliendo un ricorso presentato da Usb Pubblico Impiego attraverso l’avvocato Mario Soggia, ha dichiarato il diritto di una dipendente della Direzione della Polizia Locale di Taranto “a svolgere le proprie mansioni in modalità di lavoro agile in misura non inferiore al 50%”.
Si tratta di una lavoratrice vedova con tre figli disabili a carico, che più volte si era vista opporre un rifiuto alla sua richiesta. “Sulla base della condizione di lavoratrice fragile – osserva l’Usb – è evidente che la donna va ulteriormente tutelata in un momento in cui il territorio jonico vive con particolare intensità gli effetti dell’emergenza sanitaria legata al Covid. Se infatti non le si permettesse di lavorare in smart working, quantomeno per una parte delle ore previste, la stessa sarebbe esposta al serio rischio di contrarre il virus e trasmetterlo ai propri figli o comunque di non poterli più assistere”.
Per l’Unione sindacale di base si tratta di “una vittoria” che consente di veder “ristabilito – viene sottolineato – il diritto di una lavoratrice con importanti carichi familiari”.
