Roma, 24 agosto 2021 – Un recente studio dell’agenzia europea Eurofound “Disabilità e integrazione nel mercato del lavoro: tendenze politiche e sostegno negli Stati membri dell’UE”, ha ricordato che la partecipazione delle persone con disabilità al mercato del lavoro “rimane una sfida” nell’Unione europea. Secondo lo studio, in particolare, per effetto della pandemia si sono acuiti i principali ostacoli all’occupazione delle persone con disabilità, a partire dalla stigmatizzazione verso le persone disabili, fino ad arrivare alle difficoltà burocratiche nell’accesso ai servizi disponibili e alla mancanza di risorse finanziarie adeguate.
Nei giorni scorsi Lorenzo Torto, ragazzo di 33 anni, disabile, proprio su questo tema ha inviato ai commissari europei Nicolas Schmit (Occupazione, gli affari sociali e l’integrazione) ed Helena Dalli (Uguaglianza), una lettera i cui rimette al centro puntigliosamente i nodi di questo grave ritardo. La lettera ha il pregio della completezza. La pubblichiamo integralmente proprio perché ha il valore di una scheda estremamente attuale.
Proprio Helena Dalli ha annunciato il lancio di un nuovo pacchetto di misure per supportare l’inclusione lavorativa delle persone disabili nell’UE: “La Commissione presenterà nel 2022 un pacchetto di misure per migliorare i risultati sul mercato del lavoro delle persone con disabilità, una delle iniziative faro della strategia per i diritti delle persone con disabilità 2021-2030. Il pacchetto fornirà orientamenti e sosterrà l’apprendimento reciproco su temi comprendenti gli incentivi all’assunzione, la lotta agli stereotipi e il rafforzamento della prestazione di servizi”.
“Il sistema del Collocamento Disabili in Italia – si legge nella missiva di Torto – non funziona e non sarà in grado di affrontare le nuove sfide occupazionali. È ora, quindi, di costruire un’alternativa, una strategia, un soggetto in grado di rilanciare la cultura inclusiva e l’inserimento lavorativo delle persone con disabilità. Al silenzio politico e istituzionale si accompagnerà, inoltre, il mutismo dei mass-media e di tutte le parti sociali che dovrebbero sostenere l’occupazione delle persone con disabilità, rilevando al tempo stesso che anche le proteste delle famiglie, delle persone con disabilità stesse e delle aziende si sono assopite. Nessuno – prosegue – sostiene e rivendica i propri diritti e i propri bisogni: le rivendicazioni collettive hanno lasciato spazio a un ribellismo sterile e a un’invettiva narcisistica sui social, creando così un vuoto sociale d’interesse e di partecipazione. Riprova evidente di questo atteggiamento sociale e politico è il declino del Collocamento Disabili pubblico, il calo occupazionale dei disabili, l’assenza di dati statistici e così via”.
“La realtà – scrive Torto – evidenzia una serie di contraddizioni che hanno complicato il processo inclusivo delle persone con disabilità. Il personale degli Uffici Provinciali preposti è scarsamente preparato e aggiornato; infatti nell’anno 2000 il personale del nuovo Collocamento Mirato fu scelto fra i dipendenti dell’ex Collocamento Obbligatorio del Ministero del Lavoro, personale che non era stato riqualificato e che di conseguenza portò i servizi provinciali verso un’eccessiva burocratizzazione degli uffici. Anche il successivo turnover ha visto l’impiego di personale non formato adeguatamente cui è mancato pure l’aggiornamento. Pertanto la maggior parte del personale dedicato è privo di un’adeguata preparazione e non è al passo con i cambiamenti avvenuti nel mondo del lavoro e nel mercato del lavoro; a ciò si si aggiunga purtroppo la mancanza di un’adeguata conoscenza delle persone con disabilità. Per queste ragioni è stato vanificato il concetto di collocamento mirato che era alla base della riforma del collocamento obbligatorio. E ancora, il sistema di collocamento disabili è privo di una gerarchia competente regionale e nazionale. Si sono quindi sviluppati servizi provinciali di tipo “feudale”, dove gli usi e i costumi locali prendono il sopravvento, fino ad operare in contrapposizione alle leggi e alle norme ministeriali. Si tratta infatti di procedure che variano da Regione a Regione e da Provincia a Provincia, all’insegna di un operare senza controlli superiori e senza possibilità di appello per il cittadino con disabilità e per gli imprenditori insoddisfatti. Del resto, è facile dire che se i disabili non trovano un’ occupazione è per colpa della loro invalidità o per i pregiudizi delle aziende, dal momento che queste ultime vengono da sempre vissute, da parte degli uffici, come una controparte refrattaria a rispettare gli obblighi di legge”.
“Gli Uffici Provinciali per il Collocamento, quindi, sono privi di uno spirito di servizio verso le persone con disabilità e le aziende, mentre verso le amministrazioni pubbliche che non rispettano gli obblighi è diffuso un atteggiamento reverenziale, alla luce delle possibili ripercussioni che implicano eventuali azioni impositive o sanzionatorie nei loro confronti. Di tutto questo l’opinione pubblica non ha conoscenza e gli uffici interessati preferiscono tenere il sistema nella vischiosa nebbia della disattenzione politica. È anche per questo che non disponiamo ancora di una banca dati nazionale e di un aggiornamento statistico dell’operato del Collocamento Disabili (l’ultimo si rifà ai dati del 2015), né si hanno informazioni sulle risorse economiche disponibili rispetto al Fondo Nazionale Disabili della Legge 68/99 (Norme per il diritto al lavoro dei disabili) e ai Fondi Regionali”.
“C’è voluta quindi una sollecitazione dal basso – ricorda Torto – per avere un’interrogazione parlamentare, che ha fatto scoprire come gli avviamenti al lavoro siano mediamente pari al 3,4% (circa 20-30.000 persone) dei circa 800.000 iscritti, ovvero una percentuale a dir poco bassa, una delle più basse d’Europa. E ora, come detto inizialmente, la pandemia farà lievitare ulteriormente il numero degli iscritti. In Italia, ai sensi della direttiva direttiva 2000/78/CE, il datore di lavoro deve prevedere soluzioni ragionevoli per i disabili, al fine di consentire alla persona con disabilità di avere accesso al lavoro e di crescere professionalmente. Tale direttiva europea in Italia non viene di fatto applicata generando notevoli discriminazioni”.
