Roma, 27 ottobre 2021 – La circolare dell’Inps che esclude i disabili parziali dall’assegno mensile sta sollevando la contrarietà di gran parte delle associazioni di categoria. L’ultima a prendere posizione è stata l’associazione “Luca Coscioni” che chiede al Governo di intervenire “su una decisione incomprensibile da parte dell’Inps”. Anzi, “il messaggio dell’Inps potrebbe offrire l’occasione allo Stato italiano per una rivisitazione sostanziale non solo della normativa, ma anche degli importi di assegni e pensioni di invalidità, in un’ottica di non discriminazione di chi ha una disabilità accertata”.
“Applicando alcune pronunce della Corte di Cassazione, l’Inps – ricorda l’Associazione Luca Coscioni – ha interrotto l’erogazione dell’assegno mensile di assistenza, pari a 287,09 euro per 13 mensilità, a quelle persone con invalidità tra il 74% e il 99% che abbiano, per così dire, un lavoretto da 400 euro al mese, ovvero che non superi la soglia dei 4931 euro annui. Il requisito per l’erogazione di tale assegno deve essere, secondo le pronunce richiamate che hanno prodotto la decisione dell’Inps, il mancato svolgimento di qualsiasi attività lavorativa, anche minima.
Fino a questo momento, il diritto all’assegno mensile di invalidità è stato riconosciuto a chi ha un’età compresa tra i 18 e i 67 anni; una percentuale di invalidità compresa tra il 74% ed il 99%; un reddito annuo non superiore a 4.926,35 euro (pari a 378,95 euro mensili, tenendo conto anche della 13/a mensilità).
“Non si comprende come sia possibile che anche un ‘lavoretto’ con uno stipendio così basso – dice l’Associazione Coscioni – infici il diritto ad un assegno mensile di invalidità, il cui importo è talmente irrisorio (287,09 euro nel 2021) da non consentire una vita dignitosa a chi ha una accertata diminuzione della capacità lavorativa in misura pari o superiore al 74%”.
Si auspica quindi, conclude l’Associazione Coscioni “un aggiornamento dell’importo ed una revisione delle modalità di erogazione dello stesso, previa verifica dell’accertata invalidità dei soggetti cui viene riconosciuto il diritto all’assegno mensile”.
