Roma, 9 luglio 2020 – Il Garante per la protezione dei dati personali il 6 luglio 2020 ha aggiornato le FAQ, relative al trattamento dei dati nel contesto lavorativo pubblico e privato nell’ambito dell’emergenza sanitaria causata dal COVID -19, pubblicate sul proprio sito.
Precisamente, sono stati inseriti due chiarimenti in merito all’uso di app di contract tracing in ambito aziendale.
A riguardo l’Autorità ha precisato che la funzionalità di “contact tracing”, prevista da alcuni applicativi allo scopo di ricostruire i contatti significativi avuti in un periodo di tempo commisurato con quello individuato dalle autorità sanitarie in ordine alla ricostruzione della catena dei contagi ed allertare le persone che siano entrate in contatto stretto con soggetti risultati positivi, è disciplinata unicamente dall’art. 6 del D.L. n. 28/2020.
Inoltre, è stato chiarito che, al fine di contenere il rischio di contagio sul luogo di lavoro, il datore di lavoro possa ricorrere all’utilizzo di applicativi, disponibili sul mercato, purché non comportino il trattamento di dati personali riferiti a soggetti identificati o identificabili. Pertanto solo nel caso in cui il dispositivo utilizzato non sia associato o associabile, anche indirettamente, all’interessato né preveda la registrazione dei dati trattati.
