Collocamento disabili: scattano nuove sanzioni maggiorate

Roma, 2 febbraio 2022 – Dal 1° gennaio 2022 sono entrati in vigore i nuovi importi delle sanzioni per la violazione degli obblighi di assunzione dei lavoratori con disabilità. La Legge 68/1999, che disciplina il collocamento mirato dei disabili, prevede infatti una serie di adempimenti e obblighi che i datori di lavoro pubblici e privati sono tenuti a rispettare, a pena di incorrere in sanzioni che possono essere anche molto pesanti.
Il primo incremento riguarda la mancata presentazione nei termini del Prospetto informativo disabili, come previsto dall’articolo 9 comma 6 della legge 68/1999. I  datori  di  lavoro  pubblici e privati, soggetti agli obblighi di assunzione, sono tenuti ad  inviare in via telematica agli uffici competenti un prospetto dal quale risultino il numero complessivo dei lavoratori dipendenti, il  numero e i nominativi dei lavoratori computabili nella quota di  riserva,  nonché i posti di lavoro e le mansioni disponibili per i lavoratori disabili. 
Il prospetto informativo deve essere inviato entro il 31 gennaio di ogni anno. Il ritardo nell’invio del prospetto, come previsto ai sensi dell’articolo 15 comma 1 della legge 68/1999, costa dal 2022 una sanzione di 702,43 euro, 36,56 euro in più rispetto allo scorso anno. A questi si aggiunge una maggiorazione di 34,02 euro per ogni giorno di ritardo nell’invio del prospetto.
Incrementate anche le sanzioni per inadempimento degli obblighi di assunzione. L’articolo 3 della legge 68 prevede che i datori di lavoro pubblici e privati sono tenuti ad avere alle loro dipendenze lavoratori con disabilità nella seguente misura:

  1. a) sette per cento dei lavoratori occupati, se occupano più di  50 dipendenti;
  2. b) due lavoratori, se occupano da 36 a 50 dipendenti;
  3. c) un lavoratore, se occupano da 15 a 35 dipendenti.

Ai sensi dell’articolo 15 comma 4 della legge 68, trascorsi sessanta giorni dalla data in cui insorge l’obbligo  di assunzione, il datore di lavoro non in regola con la copertura della quota d’obbligo, per cause a lui imputabili, dovrà pagare una sanzione amministrativa di 196,05 euro per lavoratore per ogni giorno di scopertura.
La sanzione per mancata assunzione è pari a cinque volte il contributo esonerativo, disciplinato dall’articolo 5 comma 3 della legge 68. Il contributo esonerativo è la somma dovuta dai datori di lavoro che, a fronte di specifiche condizioni, possono essere autorizzati ad impiegare un numero inferiore di disabili rispetto alla quota a cui sarebbero obbligati. Il contributo, versato al Fondo Regionale per l’occupazione dei disabili, dal 1° gennaio 2022 è pari a 39,21 euro al giorno per ciascun lavoratore disabile non assunto (a fronte dei precedenti 30,64 euro).
