16 luglio 2021 – Il Procuratore Generale della Cassazione Giovanni Salvi è stato ascoltato in Senato dalla Commissione di Inchiesta sulle condizioni di lavoro in Italia, con specifico riferimento al tema dello sfruttamento del lavoro e del caporalato.
Nel rilevare innanzitutto che il contrasto di queste pratiche rappresenta una priorità per le Procure, il Dott. Salvi ha parlato del cambio di passo realizzato con la riforma della fattispecie penale dello sfruttamento lavorativo, disciplinato dall’articolo 603-bis del codice penale, che non punisce più solamente l’intermediario, ma in modo più ampio tutte le modalità di sfruttamento del lavoro. “Elemento più significativo di differenza rispetto al passato è stato l’aver individuato lo stato di bisogno e non la vulnerabilità come elemento caratterizzante della fattispecie penale” ha precisato Bianchi “un requisito che ha consentito di allargare notevolmente la punibilità di queste condotte”. Secondo il Procuratore l’approccio penale non è l’unica strada, ma è comunque indispensabile: “da quando la responsabilità penale è mutata abbiamo riscontrato un diverso comportamento dei datori di lavoro – ha evidenziato “perché il rischio penale rientra nel calcolo costi benefici e se è alto incentiva i datori di lavoro ad agire nella legalità”. “Non possiamo tuttavia ignorare – prosegue Bianchi – che la realtà dei fatti ci pone di fronte alla forte necessità di lavoro stagionale, si parla di circa 300-400 mila unità all’anno, che spesso è reclutato in maniera irregolare. Ricorrere al lavoro stagionale nel rispetto della legalità è un obiettivo prioritario ed è la direzione verso cui si muove il Protocollo d’intesa recentemente sottoscritto dai Ministeri del Lavoro, dell’Interno e dell’Agricoltura”. “Dobbiamo guardare al problema in una logica globale, per uscire dal circolo vizioso del lavoro irregolare, che genera altra irregolarità e una diffusa insicurezza” ha concluso.
