23 febbraio 2021 -La Guardia di Finanza di Magenta ha sequestrato l’azienda florovivaistica ‘Vivai Zazzera’ di Inveruno, nel Milanese, e ha arrestato il titolare, Sergio Zazzera, per caporalato su oltre 100 lavoratori in esecuzione di un’ordinanza emessa nell’inchiesta del P.m. di Milano Donata Costa.
Le indagini hanno permesso di scoprire un sistema di sfruttamento dei lavoratori che, in un clima di tensione e soggezione, lavorando per oltre 9 ore al giorno e in assenza di pause, riposi settimanali e ferie retribuite, venivano pagati al costo di quasi 3 euro all’ora, rispetto ai 13 euro circa previsti in osservanza delle norme vigenti. Il titolare dell’azienda, con la complicità illecita di due impiegate, approfittava della situazione di bisogno dei lavoratori, molti dei quali erano cittadini extra-comunitari e giovani alla prima esperienza lavorativa. I lavoratori venivano reclutati per un periodo “di prova” di 20 giorni senza pattuizione di alcun compenso o orario prestabilito, a cui seguiva sistematicamente l’instaurazione di un rapporto di lavoro che, anziché subordinato, veniva indebitamente formalizzato come “prestazione di lavoro occasionale”, consentendo ingenti e illeciti profitti al titolare, senza riconoscere alcun diritto ai lavoratori.
Alle indagini della Gdf si sono affiancati anche i controlli amministrativi dei funzionari dell’Ispettorato territoriale del Lavoro di Milano-Lodi e dell’Inps che hanno portato alla quantificazione di oltre un milione di euro di contributi previdenziali dovuti, riqualificando i contratti di lavoro del personale e “disconoscendo le agevolazioni di ‘coltivatore diretto’ del titolare”.
Il sequestro dell’azienda riguarda, in particolare, 13 immobili e beni per un valore complessivo di oltre 3 milioni di euro e 10 conti correnti riconducibili alla ditta individuale. Ed è stato nominato un amministratore giudiziario per permettere la continuazione dell’attività aziendale nel rispetto delle normative.
