Roma, 24 gennaio 2022 – La Corte di Appello di Firenze ha accolto il ricorso presentato dall’avvocato Ezio Bonanni, presidente dell’Osservatorio Nazionale Amianto, contro la sentenza di primo grado del Tribunale di Pistoia che aveva respinto la richiesta di indennità all’INAIL di Susanna Vannucci, moglie dell’autotrasportatore Emilio Corbo, deceduto nel luglio 2012 a soli 62 anni in conseguenza di un mesotelioma da esposizione ad amianto.*
Nel luglio del 2013 dinanzi ad una prima richiesta della donna, rimasta vedova con un figlio, all’epoca 28enne, l’Inail aveva negato ogni risarcimento, sostenendo che il tumore che aveva ucciso Corbo fosse una conseguenza delle fibre inalate nella sua abitazione dove era presente una stufa le cui tubature erano in amianto.
I giudici di secondo grado, invece, hanno stabilito che il raro tumore di cui fu vittima l’autotrasportatore, è scaturito dalle fibre cancerogene che per trent’anni avrebbe respirato per via del suo lavoro, dal 1979 al 2009. L’amianto era nei componenti dei veicoli che guidava, ha riconosciuto la corte, così come nei guanti che Corbo indossava per ispezionare i freni e i motori dei camion, proteggendosi dal calore.
Per questo la Corte di Appello ha condannato l’Inail al pagamento, in favore della vedova, della rendita per i superstiti e del Fondo Vittime Amianto. L’importo degli arretrati che sarà corrisposto ammonterà a circa 240 mila euro, a cui si aggiungerà la rendita mensile di reversibilità di circa 1800 euro che percepirà per tutto il resto della sua vita. Inoltre è stato liquidato anche l’assegno funerario. Su tutte le somme dovranno essere corrisposti anche gli interessi legali.
“Con questa sentenza – ha dichiarato l’Avv. Bonanni – viene ribadito un principio fondamentale a tutela delle vittime dell’amianto: anche gli autotrasportatori devono essere risarciti in quanto troppo spesso a contatto con l’asbesto”.
