Roma, 28 ottobre 2021 – Il Consiglio dei Ministri ha approvato ieri un disegno di legge delega sulla disabilità, che rientra tra le riforme e azioni chiave previste dal PNRR e consentirà una revisione complessiva della materia.
Gli ambiti di intervento della delega al Governo sono infatti:
a) definizioni della condizione di disabilità, riassetto e semplificazione della normativa di settore;
b)accertamento della condizione di disabilità e revisione dei suoi processi valutativi di base, unificando tutti gli accertamenti concernenti l’invalidità civile, la cecità civile, la sordità civile, la sordocecità, l’handicap, anche ai fini scolastici, la disabilità prevista ai fini del collocamento mirato e ogni altra normativa vigente in tema di accertamento dell’invalidità;
c) valutazione multidimensionale della disabilità, progetto personalizzato e vita indipendente;
d) informatizzazione dei processi valutativi e di archiviazione;
e) riqualificazione dei servizi pubblici in materia di inclusione e accessibilità;
f) istituzione di un Garante nazionale delle disabilità.
Come si legge nel comunicato stampa di palazzo Chigi, il cuore della riforma sarà il nuovo sistema di riconoscimento della condizione di disabilità, in linea con la Convenzione Onu. Questo nuovo sistema si basa sulla valutazione multidisciplinare della persona, finalizzata all’elaborazione di progetti di vita personalizzati che garantiscono i diritti fondamentali.
Tali interventi sono volti a supportare l’autonomia e la vita indipendente delle persone con disabilità in età adulta, prevenendo forme di istituzionalizzazione.
Il ddl “recante delega in materia di disabilità” prevede, inoltre, il potenziamento dei servizi e delle infrastrutture sociali necessari. Il Governo è altresì delegato a prevedere, nell’ottica della semplificazione, procedimenti più snelli, trasparenti ed efficienti di riesame e di rivalutazione delle condizioni di disabilità che tutelino pienamente i diritti del cittadino e di chi lo rappresenta.
Infine si prevede l’istituzione del Garante nazionale delle disabilità, che dovrà occuparsi di raccogliere le istanze e fornire adeguata assistenza alle persone con disabilità che subiscono violazioni dei propri diritti; formulare raccomandazioni e pareri alle amministrazioni interessate sulle segnalazioni raccolte, anche in relazione a specifiche situazioni e nei confronti di singoli enti; promuovere campagne di sensibilizzazione e di comunicazione per una cultura del rispetto dei diritti delle persone.
