Roma, 5 ottobre 2021 – Questo pomeriggio una delegazione dell’ANMIL ha partecipato ad un incontro in video conferenza con la Commissione Lavoro del Senato, per un confronto sul tema della salute e sicurezza nei luoghi di lavoro alla vigilia della celebrazione della 71 ͣ Giornata Nazionale per le Vittime di incidenti sul lavoro, che si terrà domenica 10 ottobre. All’audizione hanno preso parte il Presidente Nazionale Zoello Forni e i Vicepresidenti Emidio Deandri e Debora Spagnuolo.
Nel ringraziare la Presidente della Commissione, Sen. Susy Matrisciano per la disponibilità e l’attenzione, il Presidente Forni ha richiamato l’attenzione sulla nuova impennata di incidenti sul lavoro che sta coinvolgendo il nostro Paese parallelamente alla ripresa delle attività produttive evidenziando che, come dieci anni fa, ancora oggi ogni giorno mediamente tre lavoratori rimangono vittime di infortuni mortali, per non parlare di coloro che muoiono dopo anni di lunghe sofferenze, nel silenzio dei media, i cui numeri sono ben cinque volte superiori. Per questo, in occasione della Giornata, l’ANMIL vuole mantenere alta l’attenzione su questi tragici fenomeni, con lo sguardo rivolto al futuro: accanto alla spinta per la ripresa economica è quanto mai urgente rafforzare le politiche di prevenzione, potenziare il sistema ispettivo e sanzionatorio, completare l’attuazione del decreto 81/2008. Per il presidente Forni la formazione e la cultura della sicurezza rappresentano un tassello immancabile delle politiche di prevenzione, nel quale l’Associazione è direttamente impegnata. Alla Commissione è quindi stato illustrato il progetto nato con la Scuola della Testimonianza ANMIL, per la formazione di infortunati come testimonial/formatori per la sicurezza. Un’iniziativa molto apprezzata che ha già portato alla creazione di un percorso riconosciuto grazie alla collaborazione con la Regione Marche, la prima a credere in questo progetto e a riconoscere la figura del Testimonial/formatore. Forni ha quindi sottolineato l’importanza che la cultura della sicurezza sia coltivata fin dai banchi di scuola, constatando tuttavia che non è mai stata data attuazione alle disposizioni del Testo Unico che disciplinano gli interventi formativi in questo campo. Senza finanziamenti, le scuole non possono realizzare l’obiettivo di inserire la materia della salute e sicurezza in ogni attività didattica.
Sugli aspetti legati alla tutela assicurativa, il Presidente ha prioritariamente evidenziato alla Commissione il tema degli avanzi di gestione dell’INAIL, che andrebbero utilizzati per un miglioramento delle prestazioni. Sul punto la Vice presidente Spagnuolo ha sottolineato l’urgenza di una revisione complessiva del Testo Unico in materia di assicurazione contro gli infortuni sul lavoro e le malattie professionali, ormai vigente dal 1965 e non più rispondente alla società e al mondo del lavoro odierni. Un progetto a lungo termine, che dovrà essere anticipato da interventi più urgenti: tra questi, l’abbassamento della percentuale di invalidità indennizzabile in rendita dal 16 all’11%, un miglioramento delle prestazioni riconosciute ai superstiti delle vittime del lavoro, una riflessione sulle previsioni in materia di diritto al lavoro. Quest’ultimo tema in particolare, richiede sia interventi rivolti agli infortunati, con adeguati percorsi di formazione e riqualificazione professionale, sia in favore di vedove ed orfani, per i quali l’ANMIL rivendica la creazione di una quota di riserva dedicata sulle assunzioni, da portare dall’attuale 1 al 7%. La Vicepresidente Spagnuolo ha anche ricordato la questione dell’inserimento della rendita ai superstiti nel calcolo rilevante ai fini ISEE, un’ingiustizia da eliminare quanto prima per non escludere famiglie in difficoltà da prestazioni sociali e assistenziali fondamentali.
È quindi intervenuto il Vice presidente Deandri, che ha illustrato le attività dell’ANMIL sul fronte delle costituzioni di parte civile nei processi per infortuni mortali sul lavoro, al duplice scopo di rendere più efficace l’azione di prevenzione e affiancare i familiari delle vittime nei difficili percorsi processuali. L’ANMIL è attualmente presente in circa cinquanta processi penali in corso di celebrazione in tutta Italia (dall’ILVA di Taranto all’Eternit di Casale Monferrato) ed è riconosciuta come soggetto danneggiato in almeno altri venti procedimenti in attesa di trattazione. Il Vice presidente Deandri ha poi espresso il sostegno dell’ANMIL al disegno di legge sull’istituzione di una procura nazionale in materia di igiene e sicurezza sul lavoro, di cui la Commissione inizierà l’esame proprio oggi: un provvedimento importante per il miglioramento dell’azione investigativa e processuale su questi temi.
Per la Commissione ha quindi preso la parola il Sen. Floris, che ha assicurato l’impegno sul fronte della salute e sicurezza sul lavoro. Il disegno di legge sull’istituzione di una magistratura dedicata andrà nella direzione di riservare maggiore attenzione al mondo del lavoro. Ha inoltre espresso apprezzamento per gli spunti offerti dall’ANMIL, in particolare per quanto riguarda l’esclusione della rendita ai superstiti dall’ISEE, assicurando che saranno oggetto di valutazione e approfondimento da parte della Commissione. La Senatrice Drago si è soffermata sul tema della formazione, condividendo la necessità che questa parta dalle scuole, affinché i giovani conoscano non solo i propri doveri ma anche i propri diritti.
Infine, è intervenuta la Presidente della Commissione, Sen. Susy Matrisciano, che ha garantito che per la Commissione la salute e sicurezza sul lavoro ricoprono un ruolo primario. L’emergenza va affrontata in una duplice prospettiva, agendo sia sul prima che sul dopo: partendo dalla formazione e dall’informazione, dai controlli e dalle misure di prevenzione, per arrivare ad assicurare giustizia alle vittime. Anche da parte della Presidente l’impegno a valutare le proposte dell’ANMIL, nel segno di una reciproca collaborazione.
