Domanda:
Buongiorno, sono un Infermiere e lavoro da oltre 20 anni. A causa della mia professione, ho contratto ad oggi, cinque ernie lombari e sacrali altamente invalidanti al punto che nell’ultimo periodo, sono stato costretto, a causa di infortuni e malattie per riacutizzazioni e recidive, ad assentarmi spesso dal lavoro per curarmi. Le mie domande sono: come faccio a fare richiesta di malattia professionale visto che le ernie le ho contratte sul lavoro? Come faccio sul lavoro a farmi tutelare per non aggravare il mio stato di salute, visto che il datore di lavoro non mi tutela?

Gentile signore,
le patologie di cui soffre possono rientrare tra le malattie professionali se ricondotte all’attività lavorativa svolta a seguito dell’esposizione ad uno o più fattori di rischio presenti nel ciclo lavorativo stesso o nell’ambiente di lavoro.
Per ottenere il riconoscimento della malattia professionale deve:
– denunciare la malattia professionale al Suo datore di lavoro entro il termine di 15 giorni dalla manifestazione di essa, altrimenti perde il diritto all’indennizzo per il tempo antecedente la denuncia;
– allegare il certificato medico rilasciato dal medico curante o da una struttura sanitaria. Il certificato medico consente all’INAIL di avviare il procedimento che permetterà di accedere alle prestazioni economiche, sanitarie e riabilitative previste in caso di riconoscimento malattia professionale.
Una copia deve essere consegnata subito al proprio datore di lavoro, una copia deve essere conservata in originale dal lavoratore.
Il datore di lavoro ha l’obbligo di inviare la denuncia all’INAIL entro i 5 giorni successivi, decorrenti dalla data di ricezione del certificato medico. La violazione di questo obbligo è soggetta a sanzioni amministrative.
In caso di inerzia del datore di lavoro, il lavoratore stesso può presentare la denuncia di malattia professionale rivolgendosi direttamente all’INAIL, per via telematica ovvero per il tramite di un Patronato. Di norma l’Istituto dovrebbe rispondere entro 30 giorni dalla data di ricevimento del certificato medico definitivo. In realtà tale termine difficilmente viene rispettato; la tempistica, però, varia da sede a sede ed è in funzione del carico di lavoro contingente.
Nelle more, in considerazione del Suo stato di salute, il consiglio che posso darle è quello di rivolgersi al medico competente dell’azienda sanitaria in cui lavora che potrebbe intervenire eventualmente sulla questione attestando la necessità di svolgere le mansioni a lei più idonee.
Può comunque rivolgersi al Patronato ANMIL, anche attraverso il numero verde 800 180 943, qualora volesse ulteriori informazioni in merito ovvero aiuto nella predisposizione ed invio della domanda di riconoscimento.
