Domanda:
Buongiorno, mio marito nel 2015 ha subito un infortunio in itinere. Nel 2016, a chiusura dell’infortunio, gli hanno valutato una percentuale del 30% di invalidità. Abbiamo fatto ricorso e ha ottenuto il 34%. Da allora non l’hanno più chiamato per visite di controllo, abbiamo chiesto all’INAIL il motivo e ha in programma una sola visita nel 2026, a chiusura quindi del decennio dalla rendita. Ora la sua situazione è peggiorata. Sia al ginocchio che all’anca ha l’artrite. Possiamo chiedere l’aggravamento, giusto? Una volta chiesto la prima volta, non possiamo più chiedere un altro aggravamento?
Sta ancora facendo controlli col suo ortopedico che, presto o tardi, dovrà fargli una protesi. In questo caso dovremo aprire ancora l’infortunio, alla chiusura cosa dovranno fare? Una nuova visita per la valutazione della nuova percentuale? La percentuale della protesi verrà sommata al 34% o dovranno ricalcolare tutto quanto?
Purtroppo da quando ha subito l’infortunio, non ha più potuto lavorare. Ha diritto all’assegno di incollocabilità? Grazie mille.
Risposta:
Gentile signora,
per gli infortuni sul lavoro la revisione per aggravamento può essere disposta dall’INAIL o richiesta dall’interessato entro 10 anni dalla data di decorrenza della rendita.
Nello specifico, la prima revisione può essere richiesta o disposta solo dopo trascorso un anno dalla data di decorrenza della rendita.
Le visite successive alla prima possono essere effettuate:
– non prima di un anno dalla precedente (nei primi quattro anni il lavoratore può essere sottoposto a visita al massimo quattro volte);
– dopo i primi quattro anni sono possibili altre due revisioni dalla decorrenza della rendita:
– alla scadenza del settimo anno;
– alla scadenza del decimo anno.
Nel caso di riapertura dell’infortunio, qualora al termine si ritenga che effettivamente le condizioni di salute dell’infortunato siano peggiorate, si potrà richiedere visita di revisione nel rispetto dei termini sopra indicati. L’eventuale maggiorazione del grado di invalidità riconosciuto verrà sommato al precedente.
In merito all’assegno di incollocabilità, si precisa che trattasi di una prestazione economica spettante al titolare di rendita, che si trova nell’impossibilità di fruire dell’assunzione obbligatoria, al ricorrere dei seguenti requisiti:
• età non superiore a 65 anni;
• impossibilità ad essere collocato in qualsiasi settore lavorativo, riconosciuta dagli Organismi competenti;
• grado di inabilità, per infortuni sul lavoro o malattie professionali, non inferiore al 34% riconosciuto dall’INAIL secondo le tabelle allegate al T.U., per eventi verificatisi fino al 31 dicembre 2006;
• grado di menomazione dell’integrità psicofisica – danno biologico superiore al 20% riconosciuto secondo le tabelle allegate all’art. 13 del D.Lgs. 38/2000, per eventi verificatisi dal 1° gennaio 2007.
L’INAIL provvede all’accertamento della disabilità, al rilascio della certificazione nella quale si specifica che l’interessato non può fruire del collocamento obbligatorio per la perdita di ogni capacità lavorativa e all’attivazione immediata delle procedure per l’erogazione dell’assegno di incollocabilità.
Può, comunque, rivolgersi al Patronato ANMIL, anche attraverso il numero verde 800 180 943, qualora necessitasse di assistenza e/o volesse ulteriori e più approfondite informazioni in merito.
