Buongiorno, volevo delle informazioni. Sono titolare di una rendita Inail a superstiti perché mio marito è deceduto a seguito di un incidente sul lavoro. Da 3 anni sono diventata inabile al lavoro al 70% per varie problematiche di malattie. Attualmente ho diritto ad una quota di rendita ai superstiti pari al 50%, la somma è minima e non potendo più lavorare ho difficoltà ad arrivare a fine mese. Potrei chiedere un ricalcolo della quota di rendita ai superstiti? Grazie.

Gentile signora,
in merito al Suo quesito, purtroppo La informiamo che non è possibile procedere ad un ricalcolo della quota di rendita ai superstiti che , pertanto, resta confermata nella misura del 50%.
Tuttavia, in considerazione del Suo grado di inabilità al lavoro, potrebbe esserle, invece, riconosciuto l’assegno ordinario d’invalidità che spetta ai lavoratori dipendenti e autonomi, ascritti all’assicurazione generale obbligatoria INPS, affetti da infermità fisica o mentale non derivante da causa di servizio, accertata dai medici dell’INPS.
La natura della patologia invalidante deve essere tale da provocare una riduzione permanente di due terzi della capacità lavorativa in occupazioni confacenti alle attitudini del lavoratore.
Inoltre è richiesta anche un’anzianità assicurativa e contributiva pari a 5 anni (260 contributi settimanali), dei quali almeno 3 anni (156 contributi settimanali) versati nel quinquennio precedente la domanda, ed essere assicurato presso l’INPS da almeno 5 anni.
In merito, al fine di poter effettuare una corretta valutazione del caso, il consiglio che possiamo darle è quello di rivolgersi al Patronato ANMIL a Lei più vicino, anche attraverso il numero verde 800 180 943, per avere un appuntamento con uno dei nostri consulenti medico-legali che, documenti alla mani, potrà fornirle le adeguate indicazioni sulla possibilità di presentare la domanda per ottenere l’assegno ordinario d’invalidità.
