Salve,
sono un’insegnante di scuola dell’infanzia di 54 anni ancora in servizio. Undici anni fa ho avuto un infortunio a scuola per il quale ho subito un forte trauma ad un ginocchio. Da allora ho sempre avuto problemi al ginocchio finché dopo qualche tempo mi è stata riconosciuta una forma di artrosi. Con il passare degli anni la situazione si è aggravata e solo oggi vorrei chiedere la “causa di servizio”. Chiedo a Voi delucidazioni sulla possibilità o meno di poterla richiedere ed eventualmente sulla procedura prevista. Grazie

Gentile signora,
la Legge 22 dicembre 2011, n. 214, (conversione in legge, con modificazioni, del decreto-legge 6 dicembre 2011, n. 201), ha abrogato, per i dipendenti civili della pubblica amministrazione, la possibilità di accertamento della dipendenza dell’infermità da causa di servizio e, di conseguenza, i benefici economici spettanti, lasciando questo riconoscimento soltanto per il personale appartenente al comparto sicurezza, difesa, vigili del fuoco e soccorso pubblico.
Pertanto, il riconoscimento della dipendenza di causa di servizio spetta esclusivamente (art. 1 DPR 461/2001):
– a i militari delle forze armate e dei corpi ad ordinamento militare;
– le forze di polizia, compresa quella penitenziaria e del corpo forestale dello Stato;
– i vigili del fuoco.
Le nuove disposizioni non si applicano (art. 6, Legge n. 214/11; Circolare INPS n.37/12):
- ai procedimenti in corso alla data di entrata in vigore della nuova normativa;
- ai procedimenti per i quali, alla predetta data, non sia ancora scaduto il termine di presentazione della domanda;
- ai procedimenti instaurabili d’ufficio per eventi occorsi prima della predetta data.
Detto ciò, non rientrando nelle suddette casistiche, purtroppo non potrà chiedere il riconoscimento della causa di servizio, né tantomeno presentare all’INAIL domanda di revisione per aggravamento essendo decorsi tutti i termini di legge.
