Buongiorno, vorrei informazioni sulla malattia professionale. Ho subito l’operazione di tutti e due i tunnel carpali. Attualmente sono a casa in postoperatorio, più epicondilite braccio dx. Vorrei sapere se, nel caso in cui la denuncia di malattia professionale venisse accolta dall’INAIL, il datore di lavoro può licenziarmi o trasferirmi se non dovesse trovare una mansione a me idonea per potermi ricollocare. Grazie.

Gentile Signora, in merito alla Sua domanda, si precisa che nei casi di sopravvenuta inidoneità del dipendente a svolgere le mansioni per le quali è stato assunto, sussiste il c.d. obbligo di repèchage, inteso come possibilità di collocare il dipendente presso un altro reparto o di adibirlo ad altre e diverse mansioni, incluse quelle inferiori che il lavoratore si sia detto disponibile a svolgere. In altre parole prima di poter licenziare un lavoratore in conseguenza di una sopravvenuta inidoneità alle mansioni, il datore di lavoro deve necessariamente sperimentare la sua possibilità di utilizzo in un altro settore aziendale anche trasferendolo. Può comunque rivolgersi al Patronato ANMIL, anche attraverso il numero verde 800 180 943, qualora necessitasse di ulteriori informazioni e/o assistenza.
