ANMIL HA DEPOSITATO LA COSTITUZIONE DI PARTE CIVILE
NEL PROCESSO A PRATO PER LA MORTE SUL LAVORO DI LUANA D’ORAZIO
Roma, 8 aprile 2022 – Ieri, presso il Tribunale penale di Prato dinanzi al Giudice dell’Udienza Preliminare (GUP) Dott.ssa Francesca Scarlatti, ha avuto inizio il processo per la morte di Luana D’Orazio, la 22enne rimasta uccisa nel 2021 all’interno di un macchinario in una fabbrica di Oste di Montemurlo in provincia di Prato.
L’ANMIL (Associazione fra lavoratori Mutilati e Invalidi del Lavoro), che sin da subito si è interessata al caso, con il patrocinio dell’Avv. Maria Luigia Tritto, ha depositato la dichiarazione di costituzione di parte civile al fianco dei familiari della giovanissima operaia alla quale è stata strappata la vita prematuramente in questo tragico incidente, chiedendo la condanna di chi, in violazione delle norme sulla prevenzione e sicurezza sul lavoro, ha mostrato disinteresse verso il valore della vita. Erano presenti in aula i genitori di Luana.
Hanno depositato le rispettive costituzioni di parte civile oltre alle parti private anche l’INAIL e FEMCA CISL Prato. Assente il padre biologico del figlio minore di Luana, il piccolo Donatello Larosa, rappresentato dall’Avv. Domenico Siriani del Foro di Crotone. Alla prossima udienza fissata per il 22 settembre 2022, il GUP deciderà in merito alla richiesta di ammissione delle parti civili le cui istanze sono state depositate in data odierna.
A comparire dinanzi al Giudice del Tribunale di Prato saranno i tre imputati accusati di omicidio colposo e rimozione dolosa delle cautele del macchinario a cui lavorava Luana: la titolare dell’azienda Luana Coppini, il marito Daniele Faggi considerato “titolare di fatto” dall’accusa e il tecnico manutentore esterno Mario Cusimano.
Lo scorso 6 settembre, infatti, la relazione del consulente tecnico, l’ing. Carlo Gini, ha stabilito che l’operaia è morta a causa della manomissione del macchinario. Secondo la ricostruzione, Luana ha avviato il macchinario in modalità automatica alle ore 9.45 e, un minuto dopo, si è spostata vicino al subbio (il rullo su cui si avvolge il filo prima di fare l’ordito) dove è rimasta agganciata ad una sbarra che sporgeva più del dovuto e che l’ha risucchiata all’interno del motore tirandola per la maglia, la felpa e i leggins.
Secondo il consulente della Procura, il corpo della giovane ha girato per due volte “in un abbraccio mortale” come ha scritto il perito, insieme all’albero del subbio. Dopo 7 secondi un collega è intervenuto spegnendo il macchinario con il pulsante di stop. Purtroppo ciò non è servito ad evitare il peggio. Luana è morta sul colpo per lo “schiacciamento del torace” come ha dimostrato l’autopsia. Se il cancello di protezione fosse stato abbassato come dovuto, la giovane non si sarebbe trovata in quella posizione pericolosa. La serie di manomissioni sul macchinario, secondo il perito, hanno creato il nesso causale con la morte della ragazza.
Una tesi non condivisa dai legali dei due coniugi indagati, che avevano chiesto l’incidente probatorio sul macchinario. Richiesta che era stata respinta dal giudice per le indagini preliminari.
Nelle more, intanto, a pochi giorni dall’udienza preliminare, è arrivata un’offerta economica di un milione e 200mila euro per i familiari di Luana da parte della compagnia con cui aveva una copertura assicurativa la ditta.
“Questa storia di denaro sbandierato ai quattro venti come se la morte di mia figlia avesse un prezzo – commenta Emma Marrazzo la madre di Luana – mi fa stare male. Il dolore non si quantifica e non si mercifica e comunque queste cose vanno fatte nelle sedi opportune, perché per me, gettarmele addosso, sono come pugnalate al cuore. Se queste persone vogliono preparare strategie di difesa lo facciano in silenzio senza tormentare me e la mia famiglia. Non si può giocare con la vita di una famiglia colpita duramente da una tragedia. Io sto vivendo un calvario infinito ma il mio dolore non viene rispettato”.
“Ho solo due grandi desideri – conclude la donna – ovvero che sia fatta giustizia e che non ci siano più morti sul lavoro”.
