Con decorrenza 1° gennaio 2021 la rivalutazione delle prestazioni economiche erogate a seguito di infortunio e malattia professionale sarà pari al 4,9% e sarà applicato dal rateo del 1° febbraio 2022, con recupero di tutti gli arretrati maturati dal 1° gennaio 2021 in base a quanto confermato dall’attesa circolare INAIL n. 36/2021.
Per quanto riguarda le rendite, per quelle riferite ad eventi precedenti il 25 luglio 2000, calcolate secondo il sistema del Testo Unico e quindi interamente patrimoniali, la percentuale di rivalutazione sarà applicata all’intero importo. Per le rendite riferite ad eventi successivi al 25 luglio 2000 saranno invece rivalutate del 4,9% solo per la parte patrimoniale, mentre la componente di danno biologico, che segue un altro meccanismo di rivalutazione, resterà invariata.
Di seguito i punti principali della circolare emanata dall’Istituto.
Prestazioni economiche
- Rendite per inabilità permanente
In sede di prima liquidazione delle rendite per inabilità permanente operano le misure retributive di seguito indicate.
Nel settore industria la retribuzione media giornaliera per la determinazione del minimale e massimale della retribuzione annua è fissata in euro 83,09. Di conseguenza:
- Retribuzione annua minima: euro 17.448,90;
- Retribuzione annua massima: euro 32.405,10.
Per il personale del settore marittimo operano gli stessi importi validi per il settore industria, ad eccezione dei seguenti:
- Comandanti e capi macchinisti: retribuzione annua massima 46.663,34;
- Primi ufficiali di coperta e di macchina: retribuzione annua massima 39.534,22;
- Altri ufficiali: retribuzione annua massima 35.969,66.
Nel settore agricoltura la retribuzione convenzionale annua per la liquidazione delle rendite è fissata in euro 26.336,74. In particolare:
- Per i lavoratori subordinati a tempo determinato: euro 26.336,74;
- Per i lavoratori subordinati a tempo indeterminato: è calcolata sulla retribuzione effettiva compresa tra un minimo di euro 17.448,90 e un massimo di euro 32.405,10;
- Per i lavoratori autonomi: euro 17.448,90.
- Prestazioni per infortunio in ambito domestico
Per gli infortuni in ambito domestico la retribuzione convenzionale annua per la liquidazione delle rendite è pari al minimale del settore industria, quindi euro 17.448,90.
L’importo della prestazione una tantum per inabilità permanente compresa tra il 6 e il 15% (per gli eventi occorsi a decorrere dal 1° gennaio 2019) è fissata nella misura di euro 337,41.
- Assegno una tantum in caso di morte
Per i settori industria, agricoltura, navigazione e infortuni in ambito domestico l’assegno una tantum in favore dei superstiti è fissato in euro 10.542,45.
- Indennità giornaliera per inabilità temporanea assoluta in agricoltura
I riferimenti retributivi sono quelli di seguito indicati:
- Per i lavoratori subordinati a tempo determinato: su retribuzione effettiva giornaliera, fatto salvo il limite minimo di euro 45,70;
- Per i lavoratori subordinati a tempo indeterminato: su retribuzione effettiva giornaliera, fatto salvo il limite minimo di euro 45,70;
- Per i lavoratori autonomi: su retribuzione giornaliera minima prevista per il settore industria, pari a euro 51,38.
- Assegno per assistenza personale continuativa
A decorrere dal 1° gennaio 2021 ammonta a euro 574,59.
- Assegni continuativi mensili
Sono rideterminati come di seguito indicato.

RILIQUIDAZIONE DELLE PRESTAZIONI IN CORSO
Alle operazioni di riliquidazione delle prestazioni in corso provvede la Direzione Centrale INAIL per l’organizzazione digitale.
I coefficienti di rivalutazione delle basi retributive sono:
- Per l’anno 2019 e precedenti: 1,049;
- Per l’anno 2020: 1,000.
Gli importi relativi alla rivalutazione delle rendite sono liquidati d’ufficio con il rateo di rendita elaborato nel mese di febbraio 2022.
La Direzione Centrale INAIL per l’organizzazione digitale invia agli interessati, come di consueto, la comunicazione concernente il provvedimento di liquidazione delle rendite con l’indicazione del relativo conguaglio, mediante i modelli 170/I e 171/I.
