Il 16 dicembre 2016 un gravissimo infortunio sul lavoro avvenuto all’interno dello stabilimento Plastotecnica di Bagnoli di Sopra (PD) provocò la morte del 38enne Damiano Varetto, rimasto schiacciato dal coperchio di una tramoggia, macchinario impiegato per la macinazione di fogli in polietilene, sul quale stava eseguendo un intervento di manutenzione. Nel processo aperto presso il Tribunale di Padova dove risultano imputati il legale rappresentante della Plastotecnica Spa Gianni Nelti e il tecnico manutentore Luca Fabbian, accusati di omicidio colposo e violazione di una serie di norme in materia di sicurezza sul lavoro, l’ANMIL è riuscita ad ottenere il positivo provvedimento di ammissione come parte civile nel processo. Nonostante l’opposizione dei legali delle controparti l’ANMIL, assistita dall’Avv. Aldo Arena del foro di Bergamo, è stata ammessa in base al seguente ragionamento del Giudice: “In ragione della previsione normativa e della relazione allegata alla richiesta, unitamente all’indicazione delle finalità perseguite dall’ente ed al fatto così come configurato al capo di imputazione, di violazione delle norme in tema di sicurezza sul lavoro, è in astratto ipotizzabile un danno per l’associazione, con attiva e diffusa sul territorio padovano e che pertanto, per vai dell’assetto locale delineato, è possibile indagare un interesse locale alla costituzione nel presente procedimento”. Il processo proseguirà dunque con l’apertura della fase dibattimentale e l’acquisizione delle prove ammesse dal Giudice, con udienza fissata al 5 novembre 2019.
