7 febbraio 2022 – Recentemente il Tribunale di Bolzano si è pronunciato, con sentenza, su un caso che ha visto coinvolto un nostro associato, Alessandro M., in un procedimento relativo alla sospensione della rendita Inail goduta dal 1993 e cristallizzata per decorso del periodo decennale di revisione nel 2004.
Nello specifico ad Alessandro M., in seguito ad un infortunio sul lavoro è stata riconosciuta dall’INAIL una percentuale di invalidità nella misura del 35%, aumentata nel corso degli anni prima al 40% e poi al 44%.
In sede di revisione decennale l’INAIL, sede di Bolzano, con apposito provvedimento del 2004, ha confermato la sussistenza di postumi nella misura di 44 punti percentuali. Successivamente, nel 2017 l’Istituto assicuratore ha provveduto ad annullare la rendita con decorrenza 1.9.2017 ai sensi del 1 comma dell’art. 9 del Dlgs. n.38/2000.
Avverso tale provvedimento, il sig. Alessandro M. ha promosso ricorso per ottenere il ripristino della rendita dinanzi al Giudice del Lavoro che, nelle more, ha dovuto sospendere il giudizio in attesa della definizione del procedimento penale in cui Alessandro M. veniva tratto a giudizio avanti al Tribunale di Bolzano per truffa e falso ai danni dell’INAIL.
Secondo la Procura sudtirolese sulla base di una serie di certificati medici, poi risultati – secondo l’accusa – non veritieri, Alessandro M. ottenne una rendita pensionistica mensile di 790 euro lamentando una parestesia (cioè una alterazione della sensibilità) agli arti superiori. Secondo il capo d’imputazione, il bolzanino sarebbe riuscito ad indurre in errore i medici che si occuparono del suo caso. All’uomo viene anche contestato il falso ideologico per aver indotto alcuni medici «ad attestare falsamente malattie tali da renderlo inabile al lavoro». Nel capo d’imputazione si evince che egli sarebbe riuscito ad ottenere una pesante sopravvalutazione del livello di inabilità.
Dal canto suo anche Inail cavalcava l’inchiesta della Procura sostenendo che: “Le gravissime violazioni di legge ed i gravissimi comportamenti contestati all’imputato -costituiscono indiscutibile ed esclusiva fonte di ingenti danni patrimoniali ed extra patrimoniali subiti dall’Inail. L’istituto nazionale per l’assicurazione contro gli infortuni sul lavoro lamenta dunque anche presunti danni di immagine che dovranno essere quantificati in sede di sentenza il Tribunale di Bolzano”.
Nonostante le pesanti accuse da parte della Procura di Bolzano, il giudizio si è concluso con una sentenza che ha assolto Alessandro M. con formula piena. Addirittura il Giudice lo ha prosciolto nel merito anche per i capi dell’imputazione coperti da prescrizione.
In particolare, nella sentenza sì dà atto che Alessandro M. non si era sottratto ad esami o ad accertamenti medici disposti dall’Inail e che l’evento infortunistico del 1993 era compatibile con le patologie indennizzate.
Nel dispositivo, il Giudice dopo avere esaminato tutti i documenti dà altresì atto che “il danno subito da Alessandro M. era un danno funzionale soggetto a miglioramenti e che l’imputato era riuscito a migliorare nel tempo con le terapie.
Alessandro M. era anche accusato di avere indotto il proprio medico di base alla redazione di certificati di malattia omettendo di indicare la diagnosi. Peccato che per formulare l’accusa la Procura si era basato sui certificati telematici che per ragioni di riservatezza non riportano mai la diagnosi bensì solo la prognosi.
Alessandro M. ha, dunque, finalmente ottenuto giustizia ed ora può godere di una personale rivincita dopo anni di lunga lotta.
