Il 24 marzo 2022 è stato pubblicato in Gazzetta il nuovo d.l. 24 marzo 2022 n. 24, contenente disposizioni urgenti per il superamento delle misure anti-contagio in conseguenza della cessazione dello stato di emergenza.
A fronte della cessazione dello stato di emergenza in data 31 marzo 2022, infatti, sono state introdotte una serie di misure per superare le principali misure restrittive per il contenimento del contagio.
In linea generale, è stato eliminato il sistema a colori delle regioni e la struttura commissariale è stata sostituita da una Unità ad hoc per il completamento della campagna vaccinale e per l’adozione di altre misure di contrasto alla pandemia. Tale Unità, in coordinamento con il Ministero della Salute, sarà operativa fino al 31 dicembre 2022.
Sono state di nuovo dettate le regole sull’isolamento delle persone positive e sull’autosorveglianza dei contatti stretti. Dal 1° aprile 2022, le persone positive dovranno ancora restare presso la propria abitazione o dimora fino a guarigione. Diversamente, i “contatti stretti” dovranno adottare l’autosorveglianza fino a dieci giorni dopo la data dell’ultimo contatto stretto. Tali soggetti, inoltre, devono effettuare un test antigenico (rapido o molecolare) alla prima comparsa dei sintomi e, se ancora sintomatici, al quinto giorno successivo alla data dell’ultimo contatto.
L’uso della mascherina FFP2 resta obbligatorio per l’accesso in alcuni luoghi: mezzi di trasporto (aerei; navi e traghetti adibiti a servizi di trasporto interregionale; treni; autobus che collegano più di due regioni; autobus adibiti a servizi di noleggio con conducente; mezzi impiegati nei servizi di trasporto pubblico locale o regionale; mezzi di trasporto scolastico); funivie, cabinovie e seggiovie; spettacoli al chiuso o all’aperto in sale teatrali, sale da concerto, sale cinematografiche, locali di intrattenimento e musica dal vivo e in altri locali assimilati, nonché’ per gli eventi e le competizioni sportivi.
Ad ogni modo, fino al 30 aprile 2022, in tutti i luoghi al chiuso resta l’obbligo di indossare le mascherine, rispetto al quale sono state confermate le precedenti esenzioni.
Sul fronte del lavoro, una prima novità riguarda il potere, attribuito al Ministero della Salute, di adottare e aggiornare – attraverso ordinanze – le linee guida e i protocolli volti a regolare lo svolgimento in sicurezza dei servizi e delle attività economiche, produttive e sociali; nonché di introdurre limitazioni agli spostamenti da e per l’estero, e imporre misure sanitarie in dipendenza dei medesimi spostamenti.
In secondo luogo, fino al 30 aprile 2022, le mascherine chirurgiche per i lavoratori sono considerate Dispositivi di Protezione Individuale (DPI), ai sensi dell’art. 74 del Testo Unico Sicurezza. È importante precisare che questa disposizione si applica anche ai lavoratori addetti ai servizi domestici e familiari.
Tra le misure che disciplinano la graduale eliminazione del “Green pass base”, questa certificazione rimarrà obbligatoria nei luoghi di lavoro – pubblici e privati – fino al 30 aprile 2022.
È inoltre confermata la regola secondo cui i lavoratori che comunicano di non essere in possesso del Green pass o risultano privi della certificazione verde al momento dell’accesso al luogo di lavoro sono considerati assenti ingiustificati fino alla presentazione del Green pass e, comunque, non oltre il 30 aprile 2022. L’assenza ingiustificata non ha comunque conseguenze disciplinari e il lavoratore mantiene il diritto alla conservazione del rapporto di lavoro. Tuttavia, non sono dovuti la retribuzione, né altro compenso o emolumento, per i giorni di assenza ingiustificata.
Inoltre, dopo il quinto giorno di assenza ingiustificata, il datore di lavoro può sospendere il lavoratore per la durata corrispondente a quella del contratto di lavoro stipulato per la sostituzione, comunque per un periodo non superiore a dieci giorni lavorativi, rinnovabili fino al 30 aprile 2022. Anche in questa ipotesi, il lavoratore sospeso non avrà conseguenze disciplinari e avrà il diritto alla conservazione del rapporto di lavoro. Soltanto nel caso in cui il datore di lavoro non abbia stipulato un contratto per la sua sostituzione, il lavoratore può rientrare immediatamente nel luogo di lavoro con il Green Pass.
È confermato l’obbligo di Green Pass “rafforzato” (la certificazione verde rilasciata a seguito di vaccinazione o guarigione dal Covid-19) per alcuni servizi e attività, ma solo fino al 30 aprile 2022. Si tratta di: luoghi al chiuso per l’attività fisica e centri benessere; convegni e congressi; centri culturali, centri sociali e ricreativi (al chiuso), con esclusione dei centri educativi per l’infanzia; feste, comunque denominate, al chiuso; attività di sale gioco, sale scommesse, sale bingo e casinò; attività che abbiano luogo in sale da ballo, discoteche e locali assimilati; partecipazione del pubblico agli spettacoli aperti al pubblico, nonché’ agli eventi e alle competizioni sportivi che si svolgono al chiuso.
Rispetto alla vaccinazione, il 15 giugno 2022 decadranno tutti gli obblighi vaccinali ad eccezione del personale appartenente al comparto sanitario e socio-assistenziale.
Più in particolare, l’articolo 8 ha stabilito che, fino al 21 dicembre 2022, rimane l’obbligo di vaccinazione per le seguenti categorie:
- esercenti le professioni sanitarie e operatori di interesse sanitario;
- lavoratori impiegati in strutture residenziali, socio-assistenziali e socio-sanitarie;
- personale delle strutture sanitarie e sociosanitarie stabilite all’art. 8-ter del d.lgs. n. 502/1992.
Il 15 giugno 2022 è stata invece scelta come data per il decadimento dell’obbligo vaccinale per ulteriori categorie:
- personale della scuola, del comparto difesa, sicurezza e soccorso pubblico, della polizia locale, degli organismi di cui alla legge 3 agosto 2007, n. 124, dell’Agenzia per la cybersicurezza nazionale, degli istituti penitenziari, delle università, delle istituzioni di alta formazione artistica, musicale e coreutica e degli istituti tecnici superiori, nonché dei Corpi forestali delle Regioni a statuto speciale;
- personale docente ed educativo della scuola;
Per le categorie di persone per le quali vige l’obbligo vaccinale, fino al suo decadimento, resta fermo il regime sanzionatorio e, fino al 30 aprile 2022, tali soggetti devono possedere il “Green Pass base” per l’accesso ai luoghi di lavoro. Pertanto, dal 1° aprile al 30 aprile 2022, anche per gli ultracinquantenni sarà possibile accedere ai luoghi di lavoro con il Green Pass base, posto che dal 1° maggio l’obbligo cessa per tutti.
Sono stati poi prorogati i termini di alcune disposizioni emergenziali. Rimanendo in tema di lavoro, sono stati prorogati fino al 30 giugno 2022 le disposizioni riguardo:
- la sorveglianza sanitaria per i lavoratori maggiormente esposti a rischio di contagio (c.d. sorveglianza sanitaria eccezionale);
- il lavoro agile in forma semplificata, ai sensi dell’art. 90, co. 3 e 4, del d.l. n. 34/2020 (convertito, con modificazioni, dalla l. n. 77/2020).
