Roma, 10 gennaio 2022 – Il Sottosegretario al Lavoro Rossella Accoto ha risposto ad una interrogazione in merito l’adozione di una strategia nazionale per la sicurezza sul lavoro, ricordando innanzitutto che la prevenzione degli infortuni e il rafforzamento della sicurezza nei luoghi di lavoro sono
una priorità dell’azione di Governo.
Al riguardo il Sottosegretario Accoto fa presente che, in armonia con quanto previsto dalle normative europee e dalle convenzioni internazionale, il Comitato previsto all’articolo 5 del Testo unico sulla sicurezza (decreto legislativo n. 81 del 2008), che riveste il ruolo di cabina di regia, ha rinnovato l’impegno finalizzato alla stesura di una strategia nazionale di prevenzione, cui collegare per coerenza i Piani di tutte le Istituzioni competenti in materia, al fine di favorire una reale sinergia di azioni per garantire condizioni di salute e sicurezza nei luoghi di lavoro.
Al fine di rafforzare l’attività di controllo in materia di sicurezza sul lavoro, nel decreto-legge n. 146 del 2021, Decreto Fisco e Lavoro, è stato inoltre predisposto un pacchetto di misure che intervengono sulla disciplina di settore e che sono ispirate ad una logica unitaria e organica.
Si è deciso di procedere al contrasto dei fattori di rischio nei contesti lavorativi con una valorizzazione e un rafforzamento delle competenze attraverso due direttrici fondamentali. La prima prevede un ampliamento delle competenze in materia di salute e sicurezza dell’INL, valorizzando al massimo le sue funzioni in materia di controllo sull’organizzazione delle attività produttive e dei rapporti di lavoro.
La seconda novità assoluta è il coordinamento della pluralità di soggetti competenti a presidiare il rispetto delle norme prevenzionistiche, sia attraverso l’attribuzione all’INL di un potere di direzione tecnica delle attività di vigilanza sia attraverso l’istituzione di sistemi informativi integrati e una migliore interoperabilità tra le banche dati esistenti.
A tutela dei lavoratori il provvedimento contiene il rafforzamento e la razionalizzazione dell’attuale apparato sanzionatorio prevedendo che, per alcune fattispecie di illecito particolarmente gravi, siano irrogati provvedimenti di sospensione.
Sono, infatti, previste disposizioni che ampliano le competenze dell’Ispettorato nazionale del lavoro (INL), i cui organici vengono rinforzati (1.024 unità aggiuntive) e la cui attività è coordinata, a livello provinciale, con le ASL e rafforzano il Sistema Informativo Nazionale per la Prevenzione nei luoghi di lavoro (SINP). Inoltre, si dispone un incremento di 90 unità, in soprannumero rispetto all’organico attuale, a decorrere dal 1° gennaio 2022, del contingente di personale dell’Arma dei carabinieri.
Il rafforzamento dell’attività di controllo e repressione, secondo il Sottosegretario Accoto, è un punto fondamentale delle politiche pubbliche, ma non è sufficiente a realizzare una strategia sistemica, che per rivelarsi veramente efficace deve essere integrata con il rafforzamento delle politiche di prevenzione e di coinvolgimento attivo delle imprese nell’applicazione delle regole sulla sicurezza, anche attraverso l’introduzione di misure premiali.
Per quanto riguarda la formazione, il Sottosegretario sottolinea che questa costituisce un indispensabile strumento culturale di prevenzione perché coinvolge e responsabilizza lo stesso lavoratore rispetto ai pericoli insiti nella sua attività. La consapevolezza e la preparazione sono infatti strumenti essenziali che possono contribuire alla neutralizzazione sistemica del rischio.
Pertanto, anche quello dei controlli sull’effettività della formazione quale obbligo che deve realmente conseguire il risultato di istruire il lavoratore sui pericoli e sulle misure di prevenzione, deve costituire una direttrice ispettiva fondamentale per dare seguito ed applicazione a tutti gli altri obblighi conseguenziali in materia di sicurezza del lavoro.
L’impegno a realizzare attività formative di qualità che mirino a produrre effetti diretti sulla riduzione dei fenomeni infortunistici e tecnopatici è svolta dall’Inail attraverso una segmentazione dell’offerta formativa in materia di salute e sicurezza nei luoghi di lavoro, rivolta ai Responsabili del servizio prevenzione e protezione (RSPP). Nel 2021 sono stati realizzati importanti iniziative di aggiornamento con particolare riguardo alla gestione delle emergenze in caso di incendio e alla gestione della sicurezza nell’utilizzo di macchine e attrezzature.
Per quanto riguarda i progetti di investimento e formazione in materia di salute e sicurezza sul lavoro rivolti in particolare alle piccole, medie e micro-imprese, il Sottosegretario evidenzia che i bandi di finanziamento Isi dell’INAIL sono finalizzati a incentivare le imprese a realizzare progetti per il miglioramento dei livelli di salute e sicurezza sul lavoro, per sostenere una crescita intelligente, sostenibile, inclusiva anche in coerenza con gli obiettivi dell’Agenda ONU 2030.
La qualificazione delle imprese, ricorda Accoto, è un obiettivo prioritario nella strategia nazionale della sicurezza. È infatti opportuno coinvolgere tutte le imprese di ogni filiera produttiva, che certifichino la «qualità del prodotto», ovvero il rispetto delle norme di sicurezza, in linea con quanto si è previsto anche in riferimento al contrasto al caporalato. Lo stesso risultato potrebbe essere raggiunto condizionando l’accesso ai benefici al rispetto delle norme in materia di sicurezza sul lavoro.
Il tema della formazione, per il Sottosegretario Accoto, merita di essere considerato anche in relazione al rapporto con il mondo della scuola e nell’ambito dei programmi scolastici, con l’obiettivo di accrescere la consapevolezza e la sensibilità delle generazioni più giovani. Al pari di altri Paesi, occorre investire su una massiccia campagna di sensibilizzazione, che possa essere rivolta anche a specifici gruppi target per meglio diffonderne e rafforzarne il contenuto.
L’altra fondamentale direttrice di intervento pubblico è il contrasto al lavoro irregolare e al lavoro nero. Il tema della sicurezza non può essere disgiunto infatti da quello della garanzia della regolare costituzione dei rapporti di lavoro e della tutela dei diritti dei lavoratori. Il PNRR ha infatti previsto l’adozione di un Piano di azione nazionale per rafforzare la lotta al sommerso nei diversi settori dell’economia.
Il Sottosegretario Accoto ricorda inoltre che con il decreto ministeriale dello scorso 25 giugno è stato introdotto, a livello nazionale, il meccanismo di verifica della congruità della manodopera impiegata nel settore edile, sia nei lavori pubblici che privati, sulla base dell’accordo collettivo sottoscritto dalle Parti sociali nel settembre dello scorso anno.
La verifica di congruità, in particolare nel settore edile, può concorrere, infatti, a realizzare un’azione concreta di contrasto dei fenomeni di dumping contrattuale, promuovendo l’emersione del lavoro irregolare attraverso l’utilizzo di parametri idonei ad orientare le imprese operanti nel settore e assicurando un’effettiva tutela dei lavoratori sia sotto il profilo retributivo che per gli aspetti connessi alla salute e alla sicurezza.
Conclude assicurando l’impegno costante del Governo a proseguire, attraverso il confronto con il Parlamento e il dialogo sociale, nell’attuazione di tutte le iniziative atte a garantire il diritto di tutti a lavorare in condizioni che garantiscano al contempo la dignità, la salute e la sicurezza.
