Nello specifico, l’Istituto ha precisato che il lavoratore che deve assistere un familiare con disabilità deve esercitare il diritto di fruire dei 3 giorni di permesso mensile retribuiti e del congedo straordinario biennale entro il termine prescrizionale di 10 anni.
Non essendo normativamente previsto uno specifico termine prescrizionale per la fruizione delle prestazioni in argomento, dunque, le stesse devono ritenersi soggette alla prescrizione ordinaria decennale cosi come disciplinato dall’art.2946 del Codice Civile.
