26 settembre 2019 – A poche settimane dall’emanazione del decreto legge n. 101/2019, che ha definito le tutele lavoristiche, assicurative e prevenzionistiche dei lavoratori impiegati nelle attività di consegna di beni per conto altrui, in ambito urbano e con l’ausilio di velocipide o di veicoli a motore assimilabili, anche attraverso piattaforme digitali (c.d. riders), si riaccendono i riflettori su tale categorie di lavoratori. Infatti, la Procura di Milano ha recentemente aperto un’indagine – al momento non penale ma solo conoscitiva – volta a far luce non solo sulla violazione delle norme antinfortunistiche ma anche su presunti profili di sfruttamento dei lavoratori e tra i lavoratori del settore, rispetto ai quali paiono addirittura ipotizzarsi casi di caporalato.
Dalle notizie diffuse a mezzo stampa, infatti, sembrano essere stati rilevati casi di cessione, da parte degli stessi ciclofattorini, degli strumenti usati per effettuare le consegne a persone sprovviste di documenti in regola, in cambio di una percentuale dell’incasso su ogni consegna.
L’indagine è stata altresì estesa alla sicurezza stradale. Precisamente, agli incidenti stradali che vedono coinvolti i ciclofattorini. A riguardo, secondo alcune testate giornalistiche, la Procura di Milano sembrerebbe intenzionata a trattare ogni singolo incidente stradale che li vede coinvolti come un caso di “infortunio sul lavoro”, con la conseguente affermazione della responsabilità penale dei datori di lavoro (ex d.lgs. n. 81/2008 e codice penale) e della responsabilità amministrativa delle aziende (ex d.lgs. n. 231/2001).
È stato pertanto avviato un monitoraggio degli incidenti stradali che vedono coinvolta tale tipologia di lavoratori, al fine tuttavia di tutelare non solo loro ma anche automobilisti e pedoni. Ultimo filone di accertamento pare essere quello sui profili igienico-sanitari riguardanti i contenitori che utilizzano.
