Roma, 6 luglio 2021 – È di ieri la notizia che ANMIL è stata ammessa come parte civile nel processo Eternit bis che si sta svolgendo davanti alla Corte d’Assise di Novara contro il magnate svizzero Stephan Schmydheiny accusato di omicidio volontario con dolo eventuale per la morte di 392 persone vittime dell’amianto nel territorio di Casale Monferrato.
I giudici hanno, infatti, dichiarato infondate le questioni di illegittimità sulla costituzione di parte civile dell’ANMIL e di altri enti ed associazioni sollevate durante la prima udienza, respingendo così tutte le eccezioni dei difensori dell’imputato.
L’ANMIL, assistita dall’Avv. Alessandra Guarini, è riuscita, dunque, ad ottenere il provvedimento positivo di ammissione come parte civile nel processo dimostrando come, alla luce delle finalità perseguite dall’ente, qualsiasi violazione in materia di salute e sicurezza sul lavoro possa determinare astrattamente un danno per l’associazione, tale da giustificare l’interesse legittimo alla costituzione stessa e la partecipazione che ne deriva al processo.
L’udienza è proseguita con l’illustrazione da parte dei difensori dell’imputato di altre eccezioni processuali, alcune peraltro già sollevate (e respinte) nei giudizi precedenti, riferite in particolare alla non precisa traduzione in tedesco degli atti notificati all’imputato e alla impossibilità di poter accedere ai reperti istologici delle persone decedute a causa del mesotelioma della pleura, la malattia causata dall’inalazione delle fibre di amianto.
Questo nuovo procedimento, così come il primo maxi processo per disastro ambientale e con numeri record sia per le vittime sia per le parti civili, è partito da Torino: i giudici hanno però deciso di dividere i fascicoli tra le procure italiane competenti territorialmente per i morti. Casale Monferrato ricade nella competenza della procura di Vercelli, che però non ha la Corte d’Assise ed è per questo che si procede a Novara.
Il processo proseguirà con la terza udienza il prossimo 12 luglio con la parola alla Procura e poi alle parti civili per le repliche.
