20 aprile 2022 – Dopo il messaggio dello scorso 22 febbraio, l’INPS ha pubblicato la circolare esplicativa dei criteri di rilascio della Disability Card, la Carta europea della disabilità. Come già anticipato, il cittadino può presentare la domanda per il rilascio della Carta utilizzando il servizio disponibile sul sito dell’INPS, accessibile tramite SPID di livello 2 o superiore, Carta di Identità elettronica 3.0 (CIE), o Carta Nazionale del Servizi (CNS).
La Carta verrà rilasciata dall’INPS a tutti i soggetti in condizione di disabilità media, grave e di non autosufficienza appartenenti alle categorie individuate nell’allegato 3 del decreto del Presidente del Consiglio dei Ministri n. 159/2013. Più precisamente, i soggetti legittimati a presentare la domanda sono i seguenti:
- invalidi civili maggiorenni con invalidità certificata superiore al 67%;
- invalidi civili minorenni;
- cittadini con indennità di accompagnamento;
- cittadini con certificazione ai sensi dell’articolo 3, comma 3, della legge 5 febbraio 1992, n. 104;
- ciechi civili;
- sordi civili;
- invalidi e inabili ai sensi della legge 12 giugno 1984, n. 222 “Revisione della disciplina della invalidità pensionabile”;
- invalidi sul lavoro con invalidità certificata maggiore del 35%;
- invalidi sul lavoro con diritto all’assegno per l’assistenza personale e continuativa o con menomazioni dell’integrità psicofisica;
- inabili alle mansioni ai sensi della legge 11 aprile 1955, n. 379, del D.P.R. 29 dicembre 1973, n. 1092, e del D.P.R. 27 luglio 2011, n. 171, e inabili ai sensi dell’articolo 13 della legge 8 agosto 1991, n. 274, e dell’articolo 2 della legge 8 agosto 1995, n. 335;
- cittadini titolari di trattamenti di privilegio ordinari e di guerra.
Dopo essere entrati nell’area dedicata al servizio, con il proprio SPID, CIE o CNS, la procedura per la presentazione della domanda visualizzerà automaticamente i dati anagrafici presenti negli archivi dell’Istituto e l’indirizzo di residenza del richiedente.
La procedura chiederà poi all’interessato di fornire:
- una propria fotografia in formato tessera (formato europeo), che sarà successivamente stampata sulla Carta;
- l’indirizzo per il recapito della Carta, se diverso da quello di residenza già noto all’INPS.
Successivamente si aprirà la schermata “Ulteriori Informazioni” in cui l’interessato potrà allegare, ove necessario, i verbali/documenti che attestano lo stato di invalidità civile. Per gli invalidi del lavoro, come precisato dall’INPS alla nostra Associazione, non è richiesto l’invio dei verbali e si potrà cliccare direttamente su “invia la domanda”. Sul punto l’Istituto ha anche ipotizzato una modifica alla procedura al fine di rendere più chiaro questo passaggio per i richiedenti con invalidità da lavoro.
Conclusa la procedura, l’INPS effettuerà tutti i controlli del caso e in caso di esito positivo invierà la Carta direttamente al cittadino tramite il gestore Poste Italiane S.p.A.
La Carta può essere utilizzata esclusivamente dal titolare per ottenere le agevolazioni previste e non è cedibile a terzi. Verrà esibita all’erogatore dei servizi e la sua presentazione esonererà dal fornire altre certificazioni che attestino la condizione di disabilità. L’erogatore, attraverso un lettore QR Code e la digitazione del codice fiscale dell’interessato, accede al servizio online di verifica.
Le agevolazioni sono attivate mediante protocolli d’intesa o convenzioni tra l’Ufficio per le politiche a favore delle persone con disabilità presso la Presidenza del Consiglio dei Ministri e soggetti pubblici o privati coerenti con i requisiti e le finalità dell’iniziativa. Sul sito istituzionale del Ministro per le Disabilità sono pubblicate le convenzioni e le agevolazioni previste. Attualmente la Carta viene riconosciuta, oltre che sull’intero territorio nazionale, anche negli altri Paesi pilota del progetto “EU Disability Card”: Belgio, Cipro, Estonia, Finlandia, Malta, Romania, Slovenia. La Commissione europea, entro il 2023, proporrà il riconoscimento della Carta in tutti gli Stati membri.
La Carta è valida fino alla permanenza della condizione di disabilità che danno titolo al riconoscimento e, comunque, per non più di dieci anni dal momento del rilascio.
