12 novembre 2021 – Il Ministero del Lavoro e delle Politiche Sociali con il decreto n. 130 del 2021, tenuto conto della nota tecnica elaborata dall’INAIL, ha rideterminato gli importi del Fondo spettante a titolo di una tantum alle famiglie delle vittime di gravi infortuni sul lavoro, per gli eventi verificatesi tra il 1° gennaio 2021 e il 31 dicembre 2021.
Ricordiamo che il “Fondo di sostegno per le famiglie delle vittime di gravi infortuni sul lavoro” è stato istituito nel 2007 con la Legge 296/2006 (Finanziaria 2007), con lo scopo di fornire un tempestivo supporto ai familiari dei lavoratori di vittime di gravi infortuni.
La gestione del Fondo è affidata al Ministero del Lavoro e delle Politiche Sociali che ne determina annualmente gli importi mentre il compito dell’erogazione dei fondi, invece, è attribuito all’INAIL.
Le prestazioni sono erogate esclusivamente per infortuni avvenuti successivamente al 1° gennaio 2007 e che abbiano comportato il decesso del lavoratore. Sono quindi esclusi sia le malattie professionali che gli infortuni avvenuti precedentemente al 1° gennaio 2007 con decesso successivo a quella data.
Possono beneficiare del Fondo non solo i lavoratori assicurati ma anche i non assicurati all’INAIL (ad esempio militari, forze di polizia, liberi professionisti, ecc.) e le persone che hanno l’assicurazione INAIL contro gli infortuni domestici. Inoltre, hanno diritto all’una tantum anche i familiari dei lavoratori deceduti per contagio da Covid 19 in occasione di lavoro.
La relativa domanda deve essere presentata da parte di uno solo dei soggetti beneficiari, entro 40 giorni dal decesso, alla sede INAIL competente per territorio, in base al domicilio del deceduto.
Di seguito, riportiamo i nuovi importi per il 2021: 5.000 euro per nuclei familiari con un solo superstite; 9.000 euro per nuclei familiari con due superstiti; 13.000 euro per nuclei familiari con tre superstiti; 19.000 euro per nuclei familiari con più di tre superstiti.
