Roma, 5 aprile 2022 – Sul finire dello scorso anno, la legge n. 162/2021 ha apportato una serie di modifiche al ‘Codice delle pari opportunità tra uomo e donna’.
Si è trattato di un intervento legislativo che, tra le altre cose, ha inasprito l’apparato di sanzioni e ha rafforzato i controlli in tema di discriminazioni di genere. Inoltre, è stata introdotta ex novo la ‘Certificazione della parità di genere’ per le imprese, in attuazione della Missione 5 del PNRR. La Certificazione consentirà di accedere al vantaggio della decontribuzione pari all’1% e a meccanismi di premialità per la partecipazione ai bandi di gara pubblici.
Tra le diverse novità introdotte, spicca anche la modifica dell’obbligo per le imprese di redigere, con cadenza biennale, un rapporto sulla situazione del personale maschile e femminile, ora estenso alle aziende con più di 50 dipendenti. Tuttavia, si rimaneva ancora in attesa del decreto attuativo che avrebbe reso operativo l’obbligo, soggetto a sanzioni e a verifiche da parte dell’Ispettorato Nazionale del Lavoro.
Finalmente in data 29 marzo 2022, il Ministro del Lavoro e delle Politiche Sociali, Andrea Orlando, e la Ministra per le Pari Opportunità e la Famiglia, Elena Bonetti, hanno firmato un Decreto interministeriale che definisce le modalità per la redazione del rapporto biennale da parte delle imprese pubbliche e private.
Più in particolare, la redazione sarà esclusivamente telematica, attraverso un apposito portale. Riguardo alle scadenze, il rapporto per il biennio 2020-2021 deve essere redatto entro e non oltre il 30 settembre 2022. Diversamente, per i rapporti riferiti ai bienni successivi è stata stabilita la data del 30 aprile dell’anno successivo alla scadenza di ciascun biennio.
A livello operativo inoltre, al termine della procedura telematica avvenuta con successo, il Ministero rilascia una ricevuta attestante la corretta redazione del rapporto. Inoltre, il datore di lavoro deve trasmettere una copia del rapporto, unitamente alla ricevuta, alle rappresentanze sindacali aziendali.
I dati trasmessi attraverso i rapporti saranno elaborati dalla consigliera o dal consigliere regionale di parità, i quali trasmetteranno i risultati agli enti pubblici diversamente coinvolti nel processo di monitoraggio e controllo sulla situazione della pari opportunità nel mondo del lavoro. Si tratta delle sedi territoriali dell’Ispettorato Nazionale del Lavoro, della consigliera o del consigliere nazionale di parità, del Ministero del Lavoro e delle Politiche Sociali, del Dipartimento per le Pari Opportunità della Presidenza del Consiglio dei Ministri, dell’ISTAT e del CNEL.
